నిర్భయ దోషుల 'ఉరి' స్టేపై దిల్లీ కోర్టులో వాదనలు
నిర్భయ దోషులకు ఉరి శిక్ష మళ్లీ వాయిదా
నిర్భయ కేసు దోషులకు ఉరి శిక్ష అమలు మళ్లీ వాయిదా పడింది. శనివారం ఉదయం 6 గంటలకు నలుగురు దోషుల్ని ఉరి తీయకుండా దిల్లీ కోర్టు స్టే ఇచ్చింది. తదుపరి ఆదేశాలు ఇచ్చేవరకు ఈ స్టే అమల్లో ఉంటుందని స్పష్టం చేసింది.
దోషుల అభ్యర్థనతో...
నలుగురు దోషుల్ని శనివారం ఉదయం 6 గంటలకు ఉరితీయాలని జనవరి 17న డెత్ వారెంట్ జారీచేసింది దిల్లీ కోర్టు. ఇందుకు అనుగుణంగా దిల్లీ తిహార్ జైలు అధికారులు అన్ని ఏర్పాట్లు చేశారు. అయితే శిక్ష అమలుపై స్టే విధించాలని న్యాయస్థానాన్ని ఆశ్రయించారు నలుగురు దోషులు. శిక్ష నుంచి తప్పించుకునేందుకు తమకు ఇంకా న్యాయపరమైన అవకాశాలు మిగిలే ఉన్నాయని, అవన్నీ పూర్తయ్యే వరకు ఉరిని వాయిదా వేయాలని కోరారు.
వాడీవేడి వాదనలు...
నిర్భయ దోషులు దాఖలు చేసిన వ్యాజ్యానికి వ్యతిరేకంగా వాదించారు తిహార్ జైలు అధికారులు. నలుగురిలో ఒకరి పిటిషన్ మాత్రమే పెండింగ్లో ఉందని.. మిగతా ముగ్గురినీ ఉరి తీయొచ్చని తెలిపారు. అయితే జైలు అధికారుల వాదనలను దోషుల తరఫు న్యాయవాది ఏపీ సింగ్ ఖండించారు. నలుగురిలో ఒక్కరి వ్యాజ్యం పెండింగ్లో ఉన్నా మిగతా వారిని ఉరి తీయకూడదన్న నిబంధన ఉందని తెలిపారు.

దేశవ్యాప్తంగా సంచలనం రేకెత్తించిన నిర్భయ దోషుల ఉరి శిక్ష అమలుపై యావత్ భారతావని ఎదురుచూస్తోంది. అయితే.. తమ ఉరి శిక్షపై స్టే విధించాలని దోషులు దాఖలు చేసిన వ్యాజ్యంపై మరికాసేపట్లో తీర్పును వెలువరించనుంది దిల్లీ న్యాయస్థానం. ఏ క్షణమైనా నిర్ణయం ప్రకటించే అవకాశముంది.
నిర్భయ కేసు దోషి పవన్ గుప్తాకు సుప్రీంకోర్టులో తీవ్ర నిరాశ మిగిలింది. నేరం చేసిన సమయంలో తాను మైనర్ను అన్న వాదనను తిరస్కరించడాన్ని సవాలు చేస్తూ దాఖలు చేసిన వ్యాజ్యాన్ని న్యాయస్థానం కొట్టివేసింది.
దోషుల తరఫున న్యాయవాదులు కోర్టులో వాదించారు. అయితే ఒక దోషి పిటిషన్ మాత్రమే పెండింగ్లో ఉందని.. మిగతా ముగ్గురిని ఉరి తీయొచ్చని తిహార్ జైలు అధికారులు కోర్టుకు తెలిపారు. ఈ తరుణంలో దిల్లీ కోర్టు తీర్పుపై అందరూ ఎంతో ఉత్కంఠగా ఎదురుచూస్తున్నారు. రేపు నలుగురు దోషులకు ఉరి శిక్ష అమలు చేస్తారా లేదా అనేది కాసేపట్లోనే తేలనుంది.

నిర్భయ దోషుల పిటిషన్పై తమ స్పందన తెలియజేయాల్సిందిగా తీహార్ అధికారులకు నోటీసులు జారీ చేసింది దిల్లీ కోర్టు. అయితే శిక్షను ఆలస్యం చేసేందుకే దోషులు ఇలాంటి పిటిషన్లు వేస్తున్నారని, చట్టాన్ని అవహేళన చేస్తున్నారని ప్రాసిక్యూషన్‌ న్యాయవాదులు ఆరోపించారు.

అయితే తిహార్ జైలు అధికారుల వాదనలు తోసిపుచ్చారు దోషుల తరఫు న్యాయవాది. ఒకరి పిటిషన్ పెండింగ్లో ఉండగా మిగతా వారికి ఉరి శిక్ష అమలు చేయలేరని నియమాలు చెబుతున్నట్లు పేర్కొన్నారు. ఈ విషయంపై వాదనలను నిరవధిక వాయిదా వేయాలని కోరారు.

27. Wide look at the mock caucus
STORYLINE:
The Iowa caucuses are never simple. Voters spend hours in high school gymnasiums or public libraries, starting their night by declaring support for their preferred US presidential candidate.
That's followed by a feverish round of lobbying in which supporters of eliminated candidates are pressed to make a new pick by the evening's end.
Caucuses are different from primaries. In a primary, voters go to the polls, cast their ballots and leave. At a caucus, voters gather at local precincts and declare support for their chosen candidate.
"I do like that it allows people to come together and engage with others in a civil manner and debate the issues of the day," Runal A. Patel, a Drake University student, said during a recent mock caucus event held on the school's campus in Des Moines.
In Iowa, voters arriving at their caucus site on Monday will fill out a card that lists their first choice.
"Preference card, it's new this time. It's a way to help us audit after the fact, so we can make sure everything is going the way it was," said Drew Kelley, a 37-year-old engineer from Clinton, Iowa.
Kelley served as a precinct captain for the Bernie Sanders campaign in 2016. This time, around he's a precinct chair.
The initial results will be tabulated and will determine the results of the "first alignment."
But that's not the end of the night.
Caucus-goers whose first-choice candidate fails to get at least 15% of the vote can switch their support to a different candidate. The threshold can be higher at some precincts. If voters don't choose another candidate, their vote won't count in the final alignment. They can choose "uncommitted," but that choice only gets reported if it, too, gets at least 15% of the vote.
The results of this stage will be tabulated to determine the caucuses' "final alignment." Only candidates who receive at least 15% of the vote at that precinct - the so-called viable candidates - will be counted in the final alignment. Non-viable candidates get zero votes in the final alignment.
"This year, you only have two opportunities to lock in your viable candidate. In the past, there's been multiple realignment attempts," Kelley said.
There's one more step.
The final alignment votes are then used to calculate the number of state convention delegates awarded to each candidate. The party calls these state delegate equivalents, because they represent the number of delegates each candidate will have at the party's state convention in June. That, in turn, determines how many national convention delegates each candidate receives.
Iowa will award 41 pledged delegates to the Democratic National Convention, based on the results of the party caucuses.
