SHOTLIST:
ASSOCIATED PRESS - AP CLIENTS ONLY
New York - 7 November 2019
1. Wide of room at LaGuardia Community College, where DACA recipients talked about the struggle to become legal citizens with fellow students and faculty
2. SOUNDBITE (English) Martín Batalla Vidal, DACA Lawsuit Plaintiff:
"Honestly, I have so much support from my community, my family, the LGBT community, and it's been great. Like, who would have thought that three years ago we fought this lawsuit. Now, next week, on Tuesday, we are going to be in the Supreme Court hearing the DACA case, which is amazing."
3. Vidal getting emotional while his friend talks about taking the DACA lawsuit to the Supreme Court
4. SOUNDBITE (English) Martín Batalla Vidal, DACA Lawsuit Plaintiff:
"I feel like we... it's overwhelming because we don't know what's going to happen. We don't know if the decision is going to be in favor or against us. But at the end of the day, we already won. We already won by having our case in the Supreme Court. And like I said, this is going to be one more fight that we have to fight for. Like at the end of the day, we're not fighting for ourselves we are fighting for TPS (referring to Temporary Protected Status) and the 11 million (an estimated total number of undocumented people in the United States). We want citizenship for all."
5. Close of Batalla Vidal during event
6. SOUNDBITE (English) Martín Batalla Vidal, DACA Lawsuit Plaintiff:
"We came out of the shadows and we are not going back to being undocumented. Like, there has to be some solution for us."
7. Tracking shot of Batalla Vidal and friends walking down hallway of LaGuardia Community College
8. SOUNDBITE (English) Martín Batalla Vidal, DACA Lawsuit Plaintiff:
"Once Jeff Sessions announced that DACA was going to be terminating -- that's when I got all the support from everyone. And honestly, it's been great because as we know, you know, Donald Trump from the beginning of the campaign, he was like -- he said that he was going to take Dreamers with heart. And as we know that didn't happen. And like I said, DACA has given us opportunities that as undocumented we would've never thought we had. Like, giving us Social Security, a driver's license, state I.D. and so many opportunities."
9. Tracking shot of Batalla Vidal and friend in college hallway
10. SOUNDBITE (English) Martín Batalla Vidal, DACA Lawsuit Plaintiff:
"Thanks to DACA I was able to work. I mean, honestly, I would've never thought I would work in the medical field, like, I always wanted to work in immigration, do other things. But once I got the opportunity to work at a rehab center as a transporter. And honestly, it was the best thing that I could do as a rehab transporter in the rehab center and it was amazing because not only would I be able to help patients but I realized that there's a language barrier. I work in Corona (Queens) so it's like the majority is Hispanics. And how can you communicate con un Latino (with a Latino) if you don't speak the language as they do? So by me being there, I was able to help them out."

12. SOUNDBITE (English) Martín Batalla Vidal, DACA Lawsuit Plaintiff (speaking about his mother):
"She wanted us to have an education. She wanted us to have opportunities that unfortunately in Mexico, it would not be possible. So, that's why she decided to bring me to the United States, you know, at the age of seven, which is great because, honestly, I would not be here if it wasn't for her."

STORYLINE:
A Mexican immigrant fighting US President Donald Trump's attempt to end a programme shielding young immigrants from deportation says he's nervous about the case finally being heard by the nation's highest court.
Martín Batalla Vidal is a lead plaintiff in one of the cases to preserve the Obama-era programme Deferred Action for Childhood Arrivals, known as DACA, and has seen his name splashed in legal documents since 2016, when he first sued in New York.
The 29-year-old certified nursing assistant at a rehabilitation clinic for traumatic brain injury in Queens, New York, has described the legal journey since then as stressful, with people sending him hateful messages. He has had to sacrifice days at work so he could go to protests, press conferences and meetings with attorneys.
Even with his worries, Batalla Vidal is hopeful immigrants like him will be able to stay in the country. The program protects about 700,000 people, known as "Dreamers," who were brought to the US illegally as children or came with families that overstayed visas.
With the attempted elimination of DACA, there was renewed pressure in Congress to pass the DREAM Act, or The Development, Relief and Education for Alien Minors, a series of never-passes proposals to protect young immigrants vulnerable to deportation. Opponents say the law rewards people for breaking the law, encourages illegal immigration and hurts American workers.
Trump ordered an end to DACA in 2017, but federal courts in different states, including New York because of Batalla Vidal's lawsuit, blocked him from ending it immediately.
The protections remain in effect at least until the US Supreme Court issues its decision, which will likely be in 2020. Participants of the program can renew their status, but no new applicants can sign up.
The Obama administration created the DACA programme in 2012 to provide social security numbers, work permits and protection from deportation to people who, in many cases, have no memory of any home other than the US.
The Trump administration argues that the program is unlawful because former President Barack Obama did not have the authority to adopt it in the first place.
Batalla Vidal initially sued when a federal court in a separate case ruled that DACA permits could not be extended for a third year, as the Obama administration wanted. Now he's part of the legal fight over DACA's very existence.
When Trump ordered the termination of the program, lawyers for Batalla Vidal amended his original lawsuit to fight the termination and added more individual plaintiffs.
A federal judge ruled in their favour. The US Supreme Court in June agreed to hear the administration's appeal of Batalla Vidal's and other cases from around the country.
On Monday, Batalla Vidal planned to arrive in Washington, on a bus with his mother, to join representatives from colleges, civil rights groups, Democratic-led states and individuals who also sued. On Tuesday, he will sit at the Supreme Court to hear oral arguments.
Batalla Vidal crossed the Mexico border when he was seven years old with his mother and a brother. He has two other brothers who are US citizens. He studies criminal justice as an undergraduate student at LaGuardia Community College.
After going to high school in Brooklyn, he said he worked making deliveries at a deli and later at a gym to save for college, and later on to support his single mother who has thyroid and osteoarthritis. Batalla Vidal also joined Make the Road New York, a nonprofit group that defends immigrant rights. Lawyers from the organization, along with the Worker and Immigrant Rights Advocacy Clinic of Yale Law School and the National Immigration Law Center filed the 2016 lawsuit.
