ബിഷപ്പ് ഫ്രാങ്കോക്കെതിരായ കേസിൽ ഇരയാക്കപ്പെട്ട കന്യാസ്ത്രീകൾക്ക് നീതി നൽകണമെന്നും അവരെ പിന്തുണയ്ക്കണമെന്നും കത്തില്‍ ആവശ്യപ്പെട്ടിട്ടുണ്ട്.

I am deeply obliged for providing me the opportunity for a further appeal to the Supreme Tribunal of the Signatura Apostolica. It is desired, in this connection, that an opportunity be granted to me to appear in person before the Tribunal I enable me to present to its honourable members my side of the situation.
It is requested, further, that I be granted an opportunity to present my case to the Pope Francis, whom I venerate and in whose sense of justice I have absolute faith.
Subject to the aforesaid caveats, I make the following submissions, trusting God as the giver and guarantor of justice, especially to the weak and the vulnerable.
1. As one who takes her spiritual calling and discipleship to Jesus Christ with utmost earnestness, it is my ardent wish that the truth be made to prevail in this and all matters ecclesial. To that end, I submit the following facts pertaining to the disciplinary action initiated recently by Sr. Ann Joseph, the Superior General, FCC; one of them being the order of dismissal served on me.
2. The second is the disciplinary action against Sr. Lissy Vadakkel, FCC; a much-respected preacher and resource person of the Congregation. She happened to give evidence in the case pertaining to the rape of a nun of the Missionaries of Jesus congregation under the Diocese of Jellundhar by the bishop in charge. Enraged that the testimony given could be unhelpful to the accused, Bishop Franco Mulakkal, Sr. Joseph sought to pressurize Sr. Lissy to change her statements in favour of the accused, coercing her, in effect, to state falsehoods. When Sr. Lissy refused to oblige, Sr. Ann Joseph resorted to punitive action by way of taking away her of her mobile phone and transferring her peremptorily to Vijawada in Andhra Pradesh, far away from her home state. She was, thereafter, put in de facto solitary confinement and denied the freedom even to communicate with her family members, at a time when her father was hospitalized with serious ailments.
Sr. Lissy continues to languish in a state tantamount to confinement in the FCC convent in Moovattupuzha. She is divested of all religious responsibilities and hindered from discharging her normal duties. Concerned at her plight, her brother sought the interference of the civil court in the region, which has ordered police protection for her. This is in public knowledge, to the extreme embarrassment of the Christian faith and the Catholic Church in Kerala, already reeling under a slew of scandals surfacing in the recent years; in particular the Bishop Franco Mulakkal rape case and the judicial custody of the accused bishop for several days.
3.I seek to bring this matter on record as it has a direct bearing on the unjust and vindictive actions initiated against me. In my case too, what purports to be ‘disciplinary action’, and what in reality are reprisals, against me commenced only after I stood by the sisters of the Missionaries of Jesus in their efforts to secure justice for the outraged nun. This is amply evident from the show cause notice issued to me, a copy of which is attached for ready reference.
I wish to re-iterate that I see nothing about what I have done, heeding the call of my faith, that calls for repentance or amendment on my side. I see no conflict or dissonance in what I have done either with my calling as a nun or my discipleship to the Lord Jesus Christ. In this instance I have done no more, or less, than what Jesus has mandated in teaching us, “Seek first the Kingdom of God and his justice…” Repenting the solidarity I expressed with my agitated and agitating fellow nuns is tantamount to repenting my loyalty and obedience to Jesus Christ, which is unthinkable for me.
I wish to urge strenuously that the actions initiated against me, and the vindictiveness it reeks of, cannot be understood aright, if they are seen in isolation from the Franco Mulakkal matter as the trigger. I fervently hope that the honourable members of the Tribunal would appreciate the truth that I am a collateral victim of this Franco Mulakkal scandal, in regard to which the mettle of the Church’s commitment to truth and justice is being tested in full public view. It does not have to be argued that the Holy See being made to be seen as partisan in this case, or as hostile to justice being available to a rape victim, is sure to discredit the witness and integrity of the Catholic Church for the years to come. It is shortsighted to coerce nuns to perjure in legal proceedings in the hope that the ends of justice can be stalled thereby. It is bound to result in extreme and undying infamy to the Church.
It is submitted that the Franco Mulakkal case has already attained unprecedented public attention and people of diverse persuasions are seized of how it is going to pan out. What aggravates its repugnance is that it has burst into public attention amidst a series of corruption charges and criminal acts ascribed to church leaders of diverse denominations in Kerala. The only thing that will salvage the credibility of the Catholic Church in this context is to be seen as committed to truth and justice, without fear or favour. Attempts to the contrary are sure to be self-condemnatory; a concern that I cannot disown.
I wish to submit in all humility and earnestness that my commitment to my spiritual vocation is my sole motive force, and it pains me deeply that I am targeted and stigmatized as a problem case only because I try to be faithful in my commitment to my spiritual calling. I rest in the hope that the honourable members of the Tribunal would take a Christ-like view of the matter and help avoid the ruination of my calling for no fault of mine. I rest my firm faith with the Tribunal that I will not be disowned and allowed to be destroyed for being faithful to my calling and responsive to the call of my spiritual conscience.
4. With reference to the above, I have to respectfully submit that, Latin being an alien tongue to me, the contents of the document under reference are incomprehensible to me. I am, therefore, in no position to act with reference to it. As far as I know, this is the first time any nun in Kerala is communicated with Kerala exclusively in Latin. Why this has been done to me is enigmatic.
Be that as it may, it is requested that an English or Malayalam version of the said document be provided to me at the earliest. It is requested, further, that the period for acting in light of the document may please be commenced w.e.f the date of providing me with the translated copy.
It doesn’t have to be stressed that serving a document in an alien tongue, when it could readily have been in a language known to the addressee, shortchanges the norms of natural justice. It is tantamount to denying the opportunity to seek justice.
I shall be grateful, hence, if an authentic translation of this document is served to me and the period for acting upon it made to commence accordingly.
