ନୂଆଦିଲ୍ଲୀ: ଭାରତୀୟ ନ୍ୟାୟିକ ବ୍ୟବସ୍ଥାର ସର୍ବୋଚ୍ଚ ଅଙ୍ଗ ସୁପ୍ରିମକୋର୍ଟଙ୍କ ଉପରେ ନାହିଁ ରାଜ୍ୟସଭା ସାଂସଦ ତଥା ବରିଷ୍ଠ ଆଇନଜୀବୀ କପିଲ ଶିବଲଙ୍କ ଭରସା । ଏପରି କିଛି ମନ୍ତବ୍ୟ ଦେଇ ଏବେ ବିବାଦରେ ପୂର୍ବତନ ବରିଷ୍ଠ କଂଗ୍ରେସ ନେତା କପିଲ ଶିବଲ । ଗତ କିଛି ମାସ ମଧ୍ୟରେ ସର୍ବୋଚ୍ଚ କୋର୍ଟ ଦେଇଥିବା ବିଭିନ୍ନ ମାମଲାର ରାୟରେ ସେ ତୀବ୍ର ଅସନ୍ତୋଷ ପ୍ରକାଶ କରି ଏପରି କହିଥିବା ଦେଖିବାକୁ ମିଳିଛି । କପିଲ କହିଛନ୍ତି,‘‘ ମୁଁ ଆଇନ ପ୍ରାକ୍ଟିସରେ 50 ବର୍ଷ ଅତିବାହିତ କରିଛି । ଯଦି ତୁମେ ଭାବୁଥିବ କୌଣସି ପ୍ରସଙ୍ଗରେ ସର୍ବୋଚ୍ଚ କୋର୍ଟରୁ ତୁମେ ଆଶ୍ବସ୍ତି ପାଇବ, ଏହା ଭୁଲ ଧାରଣ । ବର୍ତ୍ତମାନ ଯଦି କୌଣସି ଗୁରୁତ୍ବପୂର୍ଣ୍ଣ ପ୍ରସଙ୍ଗରେ ସର୍ବୋଚ୍ଚ କୋର୍ଟଙ୍କ ରାୟ ପ୍ରକାଶ ପାଉଛି, ତେବେ ମାମଲାର ବାସ୍ତବରେ ଘଟିଥିବା ଘଟଣାବଳିର ପୃଷ୍ଠଭୂମି ବଦଳି ଯାଉଛି ।’’

ଅନ୍ୟ କିଛି ଚର୍ଚ୍ଚିତ ମାମଲାରେ ମଧ୍ୟ ସର୍ବୋଚ୍ଚ କୋର୍ଟଙ୍କ କାର୍ଯ୍ୟଶୈଳୀକୁ ନେଇ ପ୍ରଶ୍ନ ଉଠାଇବା ସହ ସମାଲୋଚନା କରିଛନ୍ତି ଶିବଲ । ପୂର୍ବତନ କଂଗ୍ରେସ ସାଂସଦ ତଥା ଗୁଜୁରାଟ ହିଂସାରେ ପ୍ରାଣ ହରାଇଥିବା ଇସାନ ଜାଫରୀଙ୍କ ପତ୍ନୀ ଜାକିଆ ଜାଫରୀ କରିଥିବା ଆବେଦନକୁ ଖାରଜ କରିଦେବା ପ୍ରସଙ୍ଗରେ ସେ ସର୍ବୋଚ୍ଚ କୋର୍ଟଙ୍କ ରାୟକୁ ସମାଲୋଚନା କରିଛନ୍ତି । ସେହିପରି ଗୋଧ୍ରା ଦଙ୍ଗା ମାମଲାରେ ତତ୍କାଳୀନ ଗୁଜୁରାଟ ମୁଖ୍ୟମନ୍ତ୍ରୀ ନରେନ୍ଦ୍ର ମୋଦିଙ୍କୁ SIT କ୍ଲିନଚିଟ ଦେବା ପ୍ରସଙ୍ଗରେ ମଧ୍ୟ ସେ ଅସନ୍ତୋଷ ଜାହିର କରିଛନ୍ତି । ସେହିପରି 2009 ରେ ଛତିଶଗଡରେ ନକ୍ସଲ ଅପରେସନ ବେଳେ 17 ନିରୀହ ଆଦିବାସୀଙ୍କ ପ୍ରାଣହାନୀ ଘଟିବା ଘଟଣାରେ ମଧ୍ୟ ସେ ସର୍ବୋଚ୍ଚ କୋର୍ଟଙ୍କ କାର୍ଯ୍ୟଶୈଳୀ ଉପରେ ପ୍ରଶ୍ନ ଉଠାଇଛନ୍ତି କପିଲ ଶିବଲ ।

ତେବେ ଶିବଲଙ୍କ ଏପରି ମନ୍ତବ୍ୟ ଆସିବା ପରେ ତାଙ୍କୁ ଚାରିଆଡୁ ମଧ୍ୟ ସାମାଲଚନାର ଶିକାର ହେବାକୁ ପଡିଲାଣି । ଜଣେ ବରିଷ୍ଠ ଆଇନଜୀବୀ ତଥା ରାଜନେତା ହୋଇ ମଧ୍ୟ ସର୍ବୋଚ୍ଚ ନ୍ୟାୟାଳୟକୁ ଏପରି ଭାବେ ଚିତ୍ରଣ କରିବା ଓ ନ୍ୟାୟିକ ବ୍ୟବସ୍ଥାରୁ ଆସ୍ଥା ହରାଇବା ବୋଲି ପ୍ରକାଶ କରିବା ଘଟଣାକୁ, ବାର କାଉନସିଲ ଅଫ ଇଣ୍ଡିଆ ମଧ୍ୟ ସହଜରେ ଗ୍ରହଣ କରି ପାରିନାହିଁ । ତାଙ୍କ ଉପରେ କାଉନସିଲ କାର୍ଯ୍ୟାନୁଷ୍ଠାନ ମଧ୍ୟ କରାଯାଇପାରେ ବୋଲି ଅନୁମାନ କରାଯାଉଛି । ଗତ ରାଜ୍ୟସଭା ନିର୍ବାଚନରେ ଶିବଲ କଂଗ୍ରେସ ସହ ଦୀର୍ଘ ଦିନର ସମ୍ପର୍କ ତୁଟାଇ ଇସ୍ତଫା ଦେବା ସହ ସମାଜବାଦୀ ପାର୍ଟି ସମର୍ଥନରେ ସ୍ବାଧୀନ ଭାବେ ରାଜ୍ୟସଭାକୁ ନିର୍ବାଚିତ ହୋଇଛନ୍ତି ।
