Procurator-General Zhang Jun of the Supreme People's Procuratorate (SPP) delivered an annual work report of the SPP at the third plenary meeting of the second session of the 13th National People's Congress (NPC) in Beijing on Tuesday, with a focus on equality in protecting the legitimate rights and interests of all forms of businesses in China.
In the work report, Zhang said that the SPP has pursued a realistic and pragmatic approach in handling business-related cases, and overturned and rectified wrongful cases without hesitation.
"We protected the legitimate rights and interests of all enterprises with no difference. We've earnestly studied and implemented the spirit of the important speech delivered by General Secretary Xi Jinping at a symposium with private businessmen. In the judicial work of handling cases, we’ve strictly implemented the principle of equality for all enterprises including state-owned, private, domestic-funded, foreign-funded, large, medium-sized, small and micro-sized enterprises. We also organized researches and symposiums with the All-China Federation of Commerce and Industry to listen to private entrepreneurs' opinions," said Zhang.
The work on public interest lawsuits has made great progress over the past year, said Zhang, recalling that over the past year, the procuratorates at all levels across China supervised the restoration of about 140,000 hectares of damaged arable land, wetland, forests and pastures; the processing of 20 million tons of solid wastes and household wastes; investigation leading to the disposition of 400,000 kilograms of fake food, and 9,606 kilograms of fake and smuggled drugs, the retrieval of state-owned property valued at 25.7 billion yuan (3.78 billion U.S. dollars), the repayment of 3 billion yuan (about 4.5 billion U.S. dollars) for environment and ecological system restoration.
"In the past year, we handled 4,393 civil public interest lawsuit cases, and 108,767 administrative public interest lawsuit cases. Of these cases, 59,312 were related to ecology, environment and resources protection, 41,118 were related to food and drug safety, 10,025 involved state-owned property, 2,648 were about transfer of state-owned land use rights and 57 were concerning protection of rights of heroes and martyrs," said Zhang.
In the work report, the top prosecutor also focused on school violence cases, calling for efforts for better education for juveniles.
Last year, justifiable defense was a buzzword in three typical criminal cases raising widespread concern across the nation, in which the victims of violence struggled to fight back and killed the assailants in protecting themselves or other parties. The SPP successfully protected citizens' legitimate rights and interests by giving timely instructions to local procuratorates handling the cases.
In one of the typical cases involving road rage in east China's Kunshan City, a cyclist was freed after killing a driver as the latter threatened to stab him with a knife. The top procuratorate publicized the case as a typical case for justifiable defense.
