गुवाहाटी: प्रधान न्यायाधीश डीवाई चंद्रचूड़ ने शुक्रवार को कहा कि कानून में मानवता का स्पर्श होना चाहिए और समस्याओं की जड़ को दूर करने के लिए इसका हमेशा संवेदनशीलता के साथ इस्तेमाल किया जाना चाहिए. गौहाटी उच्च न्यायालय के 'प्लेटिनम जुबली' समारोह में न्यायमूर्ति चंद्रचूड़ ने कहा कि कानून को उन समुदायों की वास्तविकताओं को ध्यान में रखना चाहिए, जिन पर इसे लागू करना होता है.

उन्होंने कहा कि जब कानून की समझदारी से व्याख्या और क्रियान्वयन किया जाता है, तो लोगों का सामाजिक संरचना में विश्वास पैदा होता है और यह न्याय की दिशा में आगे की ओर कदम होता है. प्रधान न्यायाधीश ने कहा, 'कानून में मानवता का स्पर्श होना चाहिए...यह सुनिश्चित करने के लिए मानवीय स्पर्श आवश्यक है कि कानून सभी के हितों को पूरा करे. समानता और विविधता के लिए सहानुभूति और सम्मान होना चाहिए.'

मुख्य न्यायाधीश डीवाई चंद्रचूड़ ने कहा कि सभी लोगों के हितों की सेवा करने के लिए कानून में मानवता का स्पर्श होना चाहिए. उन्होंने कहा कि समस्याओं को खत्म करने के लिए हमेशा संवेदनशीलता के साथ इसका इस्तेमाल किया जाना चाहिए. जब कानून की समझदारी से व्याख्या की जाती है और उसे लागू किया जाता है, तो लोगों को सामाजिक संरचना में विश्वास होता है और यह न्याय की प्राप्ति की दिशा में एक कदम आगे है.

सीजेआई ने न्यायपालिका की स्वतंत्रता पर जोर दिया. उन्होंने कहा न्यायपालिका की वैधता नागरिकों से मिलने वाले विश्वास में है. उन्होंने कहा कि न्यायपालिका में लोगों का विश्वास सबसे महत्वपूर्ण है. कानून का मानवीय स्पर्श यह सुनिश्चित करने के लिए आवश्यक है कि कानून सभी लोगों की जरूरतों को पूरा करे जब कानून बिना सिद्धांत के संचालित होता है तो यह मनमानी का बोझ उठा सकता है.
