Tamil Nadu student moves SC against non-implementation of 50% OBC quota in medical admissions

A Tamil Nadu student moved SC against non-implementation of 50% OBC reservation in NEET PG 2020 examination on Thursday, seeking directions to put a stay on the selection list and restrainment from conducting admissions or any counseling, to not grant admissions or allow the selected candidates to join online or offline.

Chennai: A Tamil Nadu student, TG Babu, has moved to the Supreme Court against non-implementation of 50% OBC reservation in NEET PG 2020 examination because of which he was not selected.

Babu, a medical officer in government upgraded Primary Health Centre, Navalpakkam, said that he secured 349 marks which are above the 319 cut off fixed for OBC candidates but could not clear the cut-off list due to non-reservation.

Expressing his grievance, Babu contends that he lost the opportunity because of the faulty implementation of reservation law under Regulation 9(iv) of the Post Graduate Medical Education Regulations, 2000 and in accordance with section 4 and 5 of the Tamil Nadu Backward Classes, schedule castes and Schedule tribes Act,1993.

He seeks interim directions to put a stay on the selection list and restrainment from conducting admissions or any counselling, thereby not allowing the selected candidates to join online or offline.

The state government and some political parties such as DMK, All India Anna Dravida Munnetra Kazhagam (AIADMK), CPI (M), Tamil Nadu Congress Committee and CPI had moved the high court after the Supreme Court, on June 11, refused to entertain their petitions and asked them to approach the high court.

The high court had refused to pass any interim order on the pleas after taking note of the Centre's submission that since 1986 no reservation has been provided in the AIQ (All-India quota) seats for medical admission as per the apex court directive.

The state government and various political parties have challenged the Centre's decision not to grant 50 per cent reservation to OBCs as per Tamil Nadu law.

Some of the petitioners, in their interim prayers before the High Court, had sought to stall the ongoing admissions for PG medical courses.

The pleas had alleged that the Centre also did not follow its own policy of 27 per cent reserved seats for OBCs under the 2006 Act
