Ayodhya day-to-day hearing: Nirmohi Akhara continues with its arguments

Akhara's claim of shebait will end with dismissal of suit 5: Justice Bobde

Justice Chandrachud said, "If suit 5 is dismissed then you (Nirmohi Akhara) cannot be a shebait of a mosque!"

To which Jain replied, "If the suit is dismissed then I (Nirmohi Akhara) shall be handed over the possession."

Justice Bobde then interjected, "You make up your mind whether you want the dismissal of suit 5 or not because then your claim of shebait will also come to an end with the dismissal of suit 5."

CJI Ranjan Gogoi then said, "You can make a note on this and argue on this point tomorrow."

Continuing his submissions, Jain said that in the pleadings, there was no claim set up that there was any other shebait other than Nirmohi Akhara. He further added that there was no evidence that shebait was not working in the interest of the deity.

Documentary evidence suggest Hindus were 'Nirmohis': Jain

Justice Bobde questioned Sushil Kumar Jain, the counsel for Nirmohi Akhara, whether all the Sadhus associated with the Akhara have 'Das' in their names.

Jain then replied that they are 'Das' (servants) of Lord Ram and hence they have added Das in their names. He added that some even have 'Charan' added to their names.

He then submitted that the documentary evidence is available only with the Nirmohi Akhara and it suggests that Hindus were ‘Nirmohis’.

No cross-examination by Hindu parties, how can they oppose my rights: Counsel for Nirmohi Akhara

Sushil Kumar Jain, thecounsel for Nirmohi Akhara, reads the cross examinations of various witnesses and points out that Gopal Singh Visharad, one of the appellants in the case was not cross examined.

"With respect to my right as shebait, my right to worship and possession, there is no cross examination by Hindu parties. So how can they now oppose my rights when they have not challenged it?," Jain says.

Justice Bobde then asks, "What are you seeking through this suit?"

"I am seeking management rights and possession rights. The tradition of Puja has to be performed by me. These activites are that of a shebait and has to be performed by me," Jain replies.

Nirmohi Akhara continues with arguments

New Delhi: The Supreme Court on Monday continued its day-to-day hearing in the Ayodhya title dispute, after the Nirmohi Akhara had on Friday claimed to be the 'only friend' of the deity at the makeshift Ram temple.

Senior advocate Sushil Jain, appearing for the Nirmohi Akhara resumed making his submissions today, the 12th day of the hearing.

On Friday, the Akhara said it is the 'Shebait', a person who serves the deity in a temple. 

The Akhara claims the deity is legally recognised as a minor. Therefore, it has a valid ground to represent the deity in this dispute, and the issue of 'Shebait' is also necessary to decide the issue of relief of restoration from the receiver.
