BJP leader Gulab Chand Kataria on Saturday raised questions over tapping of phones in Rajasthan saying that authorities have denied giving permission and asked if it was not a violation of civil rights of people to tap phone without authorisation.

He also said that if Chief Minister Ashok Gehlot thinks he has a majority, he should prove it in the assembly. Addressing a press conference, Kataria said that there are provisions for phone tapping and it is used only in matters like the country's security. 

He said that permission is taken from the Home Department and concerned authorities. Referring to allegations levelled by the Congress in which it referred to tapped conversations, he asked who should be responsible for it.

Special Rajasthan police team formed to probe audio tapes' conspiracy, make arrests

A special team of Rajasthan police officers has been formed to investigate and arrest the accused in the case registered with the special operations group in connection with audio tapes that revealed a conspiracy to topple the Ashok Gehlot-led state government.

 The eight-member team headed by SP CID (Crime branch) Vikas Sharma was formed Friday after two FIRs were registered on a complaint by Congress chief whip in the state Assembly Mahesh Joshi.

The SOG has already arrested one Sanjay Sharma in connection with the conspiratorial conversation in the audio tapes and he is under police remand.

ACB lodges FIR in connection with two audio clips regarding

Anti-Corruption Bureau (ACB) has registered a case in connection with two audio clips of conversations purportedly regarding a "conspiracy" to topple the state government.

DG ACB Alok Tripathi said that the FIR was registered under the Prevention of Corruption Act on a complaint by chief whip Mahesh Joshi on Friday.

In the FIR, details of conversations of rebel MLA Bhanwarlal Sharma with Sanjay Jain and Union minister Gajendra Singh are mentioned.

While the Congress alleged that Sanjay Jain is a BJP leader, the saffron party rejected the allegation, saying he had no connection with the BJP.

New Delhi: Attacking the Congress on the on-going political crisis in Rajasthan, BJP spokesperson Sambit Patra accused the opposition party of hatching a conspiracy and creating a fake phone conversation at Chief Minister Ashok Gehlot's residence to tarnish the image of BJP. He said that the party wants a CBI probe into the into this matter, whether phone tapping was done or SOPs were followed or not.

Patra added, "It is Chief Minister's conspiracy to damage BJP's reputation and Congress wants to pin the blame of state crisis on BJP. Attempts are being made to criminally damage BJP's reputation by making fake and defamatory remarks. 

He said, "The Chief Minister should answer if there is a veiled emergency in the state. Gehlot Ji had said that there was no communication between him and Deputy Chief Minister. But people were kept in darkness. People of Rajasthan want to know whether their privacy has been compromised.

Highlighting Congress's failure, the BJP leader said, "Rajasthan crisis shows the failure of Congress high command and it has a history of tapping, demanding a CBI probe into the matter.  

He said that Rajasthan crisis is a mix of conspiracies and lies which existed in the party.

Patra posed a set of questions to rebuttal Congress's allegation:  

1. Was phone tapping done by Rajasthan officials?

2. Is phone-tapping not a sensitive and a legal issue?

3. Was the Selection of Procedure followed in phone tapping?

 4. Is the govt snooping on all the political leaders in the state?

5. Was the state's machinery misused for gain?

6. Did Congress compromise with the law?

BJP files complaint against Randeep Surjewala, others in audio clip case

BJP leader Laxmikant Bhardwaj filed a complaint against Congress leaders including Randeep Surjewala and Govind Singh Dotasra for associating Union Minister Gajendra Singh Shekhawat's name with an alleged audio clip related to conspiring to topple the elected government led by Chief Minister Ashok Gehlot in Rajasthan.

"Mahesh Joshi, Randeep Surjewala, and other accused have regularly been giving false and inflammatory statements against the BJP to criminally damage its reputation so that the blame for the current sorry state of affairs of the Congress can be pinned on the BJP. 

With the ill-intention of damaging the BJP's reputation, a conspiracy was formed at the Chief Minister's residence situated at 8 Civil lines," read the letter written by BJP Rajasthan spokesperson Bhardwaj to the Station Officer of Ashok Nagar police station read.

The Special Operations Group (SOG) of Rajasthan Police on Friday arrested Sanjay Jain whose name had surfaced in a viral audio recording about horse-trading of legislators to topple the Ashok Gehlot-led Congress government in Rajasthan, an official said.

"Jain has been arrested following interrogation into the FIR lodged on the basis of an audio recording that had gone viral on social media," Additional Director General (ATS and SOG) Ashok Rathore said. 

Jain was interrogated Thursday and Friday following which the arrest has been made, officials said.

Relief for Pilot and his supporters

Rajasthan High Court has adjourned the hearing on rebel Congress MLA's petition against disqualification notice. The speaker will also refrain from taking action against Pilot loyalists till July 21.

According to reports, the house speaker will also be present for the hearing from July 20. The notices, issued by assembly speaker, had asked the MLAs to respond by Friday to the Congress move to disqualify them from the state assembly.

The notices were served after the party complained to the Speaker that the MLAs had defied a whip to attend two Congress Legislature Party meetings.  

In its complaint to the Speaker, the Congress had sought action against Pilot and the other dissidents under paragraph 2 (1) (a) of the Tenth Schedule of the Constitution.

FIRS lodged against rebel MLAs on complaints of horse trading

Two FIRs have been registered under IPC sections 124-A (sedition) and 120-B (Conspiracy) to probe into horse-trading of MLAs and alleged audio recordings that went viral on social media.

Though the Congress leader mentioned Union Minister Shekhawat during the media briefing, there was no mention of the leader's name in the FIR lodged by party chief whip Mahesh Joshi. The complaint mentions "Gajendra Singh" but does not say if it pertains to the union minister. Union minister Shekhawat said his voice is not in those recordings and that he was ready to face any probe.

Sanjay Jain, whose name surfaced in one of the audio recordings, was called for interrogation on Thursday and is being further questioned.

Talking to reporters, Mahesh Joshi claimed, "We can recognise the voice of Bhanwarlal Sharma. He is heard talking with Sanjay Jain and then Union Minister Gajendra Singh Shekhawat. Those who have heard the audio feel that the voice matches with that of Gajendra Singh Shekhawat".

"We have registered FIR and it will become clear in the investigation. If the minister is saying that it is not his voice, then we would also be happy because if it is the voice of the union minister, this is a blot on politics. He should come on his own to SOG and should give voice samples. The MLA should also give the voice samples," he said.

Joshi had lodged a complaint demanding a probe and registration of an FIR under sedition charges against three persons, including Sharma, Gajendra Singh and Jain after the audio clips went viral.

"I had lodged a complaint with the Special Operations Group (SOG) after audio recordings went viral on social media to investigate the matter. FIR has been registered but I am yet to receive its copy," he said.

"Earlier also I had lodged a complaint and several questions were raised about evidences and delay in probe but audio recordings are now a proof. Those talking in audio recording should be identified and arrested," he added.

The SOG has so far registered three FIRs based on complaints of alleged horse trading of legislators.

Speaker to take up disqualification plea at 5 pm

A division bench of the Rajasthan High Court on Friday began hearing a petition filed by Sachin Pilot and 18 other dissident Congress MLAs, challenging the disqualification notices issued by the assembly Speaker. The notices had asked the MLAs to respond by Friday to the Congress move to disqualify them from the state assembly.

Speaker C P Joshi is expected to take up the matter at 5 pm, instead of 1 pm as mentioned in the notices.

The dissidents' petition first came up before Justice Satish Chandra Sharma on Thursday, but their advocate Harish Salve sought time to file a fresh petition. Later, in the evening, the petition was referred to a division bench.

On Friday, the petition was taken up a by a bench of Chief Justice Indrajit Mahanty and Justice Prakash Gupta.

The bench accepted a plea by Congress chief whip Mahesh Joshi to include him as a respondent in the case.

The notices were served after the party complained to the Speaker that the MLAs had defied a whip to attend two Congress Legislature Party meetings, on Monday and Tuesday.

The Pilot camp, however, argues that a party whip applies only when the assembly is in session.

In its complaint to the Speaker, the Congress had sought action against Pilot and the other dissidents under paragraph 2 (1) (a) of the Tenth Schedule of the Constitution.

The provision disqualifies MLAs if they voluntarily give up the membership of the party which they represent in the House.

Special Operations Group (SOG) on Friday lodged two FIRs over purported audio clip about conspiracy to topple Rajasthan Government. The identities of the accused are still unknown.

"Authenticity of the audio clip will be probed first," Ashoke Rathore, ADG SOG said, adding that, "We registered 2 FIRs under section 124A and 120B. The veracity of clip to be investigated."

He also said, "Sanjay Jain was interrogated yesterday, he was called today also. Presently we are trying to ascertain some facts from him."

In the audiotapes that surfaced in media a while ago, several leaders were purportedly heard discussing luring MLAs from the Ashok Gehlot camp to Sachin Pilot's side.

Meanwhile, Congress party's chief whip Mahesh Joshi is scheduled to appear before the Rajasthan HC for recording his statement.

Rajasthan Congress chief whip Mahesh Joshi on Friday said that the party is planning to file a case against Union Cabinet minister Gajendra Singh Shekhawat for his alleged involvement in poaching MLAs to topple Rajasthan government.

"I have complained to Special Operations Group (SOG) seeking an investigation, registration of case and appropriate action," Joshi said.

The statement from Joshi came after Randeep Singh Surjewala earlier read out a transcript of alleged audio of horse-trading between rebel MLAs and BJP at a press conference today.

Notably, Congress has suspended Sharma and another MLA Vishvendra Singh from the primary membership of the party for their alleged involvement in horse-trading of MLAs and demanded registration of a case against them.

The Congress party on Friday suspended MLAs Bhanwar Lal Sharma and Vishvendra Singh from the primary membership of the party.

This development was announced by party spokesperson Randeep Singh Surjewala.

"The party has also issued show-cause notices to them," he said.

Surjewala demanded the Rajasthan government and Special Operations Group to register an FIR and arrest culprits, adding that plenty of evidence has surfaced now.

Conveying Congress party's demands, he also said that Sachin Pilot should come forward and make his stand public on the allegations of providing MLAs' list to BJP.

He was referring to audiotapes aired in the media in which Union Minister Gajendra Singh Shekhawat, BJP leader Sanjay Jain & Congress MLA Bhanwar Lal Sharma spoke about bribing MLAs and bringing down Rajasthan government.

"I demand that an FIR is registered by SOG against Union Minister Gajendra Singh Shekhawat & a probe is initiated into the tape. If it is suspected that he could influence the probe, then a warrant should be issued & he should be arrested immediately," he said.

He further added, "We also demand that Congress MLA Bhanwar Lal Sharma and BJP leader Sanjay Jain should also be booked. It should also be probed as to who arranged the 'black money' to bribe MLAs & who were given the bribe."

Top Cong leadership still wants to keep 'doors open' for Sachin Pilot: Sources

Even as a section of leaders within the Congress feels that Sachin Pilot has 'gone too far', especially after he took the party to court over the disqualification issue, sources on Thursday said the top party leadership is still keeping the 'doors open' for the rebel leader and has also asked Rajasthan chief minister Ashok Gehlot to not make critical comments against his former deputy.

Sources also claimed that Pilot has spoken to a senior party leader from southern India on Thursday laying conditions for his return.

While there was no confirmation from the Pilot camp on this conversation, sources said Pilot was told unequivocally that the Congress party's 'doors are still open' for him, but he would have to return unconditionally.

He was also reportedly told that he would first have to come out of the 'BJP camp and not hobnob' with them.

According to sources, Pilot was also told that the Congress party is ready to forget this chapter and that he will be accorded equal respect on his return.

A division bench of the Rajasthan High Court will hear the petition filed by Sachin Pilot and 18 rebel MLAs, challenging the notices from the Speaker over a Congress move to disqualify them from the state assembly today at 5 pm.

The petition first came up before Justice Satish Chandra Sharma at 3 pm on Thursday. But advocate Harish Salve sought time to file a fresh petition.

The matter was heard again at about 5 pm when the judge referred the fresh petition to a division bench.

The counsel to Congress chief whip Mahesh Joshi earlier said the court had asked the advocates to appear again before it at 7.30 pm.

But the court did not assemble for the hearing, which was put off. The postponement is a matter of concern for the dissident camp led by Pilot.

The notices say Speaker C P Joshi will take up the complaint filed against them by the Congress chief whip at 5 pm today, the time set by the high court for hearing their petition.

Pilot's comments on Raje's bungalow proof of his frustration: BJP MLAs

Sachin Pilot's statement about Rajasthan Chief Minister Ashok Gehlot being busy helping former chief minister Vasundhara Raje keep her official bungalow instead of fulfilling promises made in the election manifesto reflects his frustration, two BJP MLAs said on Thursday.

In a statement, the Bharatiya Janata Party (BJP) MLAs Kailash Maghwal and Pratap Singhvi highlighted that Raje had served as the chief minister of the state twice, was a five-time legislator and also the leader of the opposition.

Pilot, the former Rajasthan deputy chief minister had in an interview said that Gehlot was busy ensuring that Raje does not have to vacate her government bungalow.

"The bungalow is allotted to Vasundhara Raje as she is a senior MLA. Bungalows are allotted to senior MLAs from time to time," the legislators said in the statement.

'Bhanwar Lal Sharma conspiring to topple govt'; MLA refutes CM Gehlot camp's claim

Senior Congress legislator Bhanwarlal Sharma, who is a Sachin Pilot loyalist, was on Thursday accused by his party members of making several attempts of toppling governments but never succeeding.

A statement, issued by the supporters of Rajasthan Chief Minister Ashok Gehlot, said that Sharma was making the fifth attempt to topple the government this time with rebel Congress leader Sachin Pilot.

"Former minister and MLA Bhanwarlal Sharma had attempted to topple the government in the 90s. This is his fifth attempt to topple the government but he never succeeded," the statement from Gehlot camp said.

Ashok Gehlot while being a union minister and PCC president that time had always objected to toppling BJP government and had said that horse-trading is not a tradition in Rajasthan," the statement said.

It further said when the then chief minister Bhairon Singh Shekhawat had gone to the US for heart surgery, Sharma had met Gehlot with the intention of overthrowing the state government.

However, Gehlot asked Sharma that conspiracy to topple the government led by a person who was in a foreign country for treatment was against morality, the statement said.

It claimed that Sharma had also distributed money to MLAs and that one of the MLAs even told Shekhawat that he was given Rs five lakh.

A seven-time MLA, Sharma was from Janata Dal at that time and he later joined Congress.

"That Bhanwarlal Sharma is again dreaming of forming a government with the help of BJP by being a part of Sachin Pilot's conspiracy," the statement alleged.

The statement was issued after audio clips surfaced in which Sharma is purportedly heard discussing with a union minister about luring MLAs from the Ashok Gehlot camp to Sachin Pilot's side.

Sharma, however, said the audio clips were fake.

"This is neither my voice nor did I talk. This is totally fake," Sharma, who is Sardarshaha (Churu) MLA, said in a video message.

Rajasthan Crisis: Special Rajasthan police team formed to probe audio tapes' conspiracy, make arrests

Jaipur: Sachin Pilot and 18 other dissident leaders on Thursday moved the high court, challenging the notices from the Rajasthan Speaker over a Congress move to disqualify them from the state assembly.

The matter is scheduled to be heard before a division bench of the Rajasthan High Court at 1 pm Friday, which is also the deadline that the Speaker's office gave the MLAs to file their replies to the notices.

Their petition first came up before the court of Justice Satish Chandra Sharma at about 3 pm. But the dissidents' advocate Harish Salve sought time to file a fresh plea.

At about 5 pm, the dissident camp submitted an amended petition and the court referred it Chief Justice Indrajit Mahanty, for the appointment of a two-judge bench.

Congress chief whip Mahesh Joshi's counsel said then that the matter will be heard at about 7.30 pm, but the bench did not assemble then.

The hearing has been put off to Friday, the counsel said. Top lawyers represent the two sides.

Abhishek Manu Singhvi, who is also a Congress leader, represents the Speaker's office. Harish Salve and Mukul Rohatgi, who have represented the BJP-led government at the Centre in the past, are the lawyers for the Pilot's camp.

The 19 MLAs were sent notices by the assembly secretariat on Tuesday and allowed up to Friday to give their replies. The notices said Speaker C P Joshi will take up the matter at 1 pm on Friday.

The notices were served after the ruling party complained to the Speaker that the MLAs had defied a party whip to attend two Congress Legislature Party meetings, on Monday and Tuesday.

The Pilot camp, however, argues that a party whip applies only when the assembly is in session.

In its complaint to the Speaker, the Congress sought action against Pilot and the other dissidents under paragraph 2 (1) (a) of the Tenth Schedule of the Constitution.

The provision disqualifies MLAs if they voluntarily give up the membership of the party which they represent in the House.

The Congress said in the letter to the Speaker that the Supreme Court has unequivocally held in the past that the provision comes into effect when the conduct of an MLA leads to this inference.

In his initial appearance, advocate Harish Salve argued that the MLAs wanted to challenge the constitutional validity of the notices and needed some time to file it afresh.

Among those sent notices are Vishvendra Singh and Ramesh Meena, who were sacked along with Pilot from the state cabinet after their rebellion against Ashok Gehlot. Pilot was also removed from the post of the state unit of the Congress.

Apart from the three sacked ministers, the other MLAs served notices are Prithviraj Meena, Ved Prakash Solanki, Suresh Modi, Deependra Singh, Bhanwar Lal Sharma, Gajraj Khatana, Indraj, Gajendra Singh Shaktawat, Hema Ram Chaudhary, Ram Niwas Gawriya, Amar Singh, Brijendra Singh Ola, Murari Lal, Mukesh Kumar Bhakar, Rakesh Parekh and Harish Meena.

The initial petition filed by the dissidents said Pilot has issued statements saying he has no intention of leaving the Congress.

It argued that that the show cause notice is contrary to the Rajasthan Legislative Assembly (Disqualification) Rules, which allows seven days to file a reply.

It said no action has been taken by the Speaker on a similar complaint, alleging defection by Bahujan Samaj Party members, since it was filed 10 months back.

Sachin Pilot has been upset since the Congress picked Ashok Gehlot for the chief minister's post after the 2018 assembly polls. His supporters said he deserved credit for the party's victory election after a campaign helmed by him as its state unit chief.

If the 19 Congress dissidents are disqualified, the current strength of the state assembly will reduce to 181, slashing the half-way mark to 91 and seemingly making it easier for Chief Minister Ashok Gehlot to retain majority support.

In the 200-member assembly, the Congress has 107 MLAs and the BJP 72.

In the past, the ruling party has claimed the support of 13 independents, two MLAs each from the CPM and the Bhartiya Tribal Party (BTP), and one from the Rashtriya Lok Dal (RLD). PTI CORR SDA

Though the Congress leader mentioned Union Minister Shekhawat during the media briefing, there was no mention of the leader's name in the FIR lodged by party chief whip Mahesh Joshi. The complaint mentions "Gajendra Singh" but does not say if it pertains to the union minister. Union minister Shekhawat said his voice is not in those recordings and that he was ready to face any probe.

Sanjay Jain, whose name surfaced in one of the audio recordings, was called for interrogation on Thursday and is being further questioned.

Talking to reporters, Mahesh Joshi claimed, "We can recognise the voice of Bhanwarlal Sharma. He is heard talking with Sanjay Jain and then Union Minister Gajendra Singh Shekhawat. Those who have heard the audio feel that the voice matches with that of Gajendra Singh Shekhawat".

"We have registered FIR and it will become clear in the investigation. If the minister is saying that it is not his voice, then we would also be happy because if it is the voice of the union minister, this is a blot on politics. He should come on his own to SOG and should give voice samples. The MLA should also give the voice samples," he said.

Joshi had lodged a complaint demanding a probe and registration of an FIR under sedition charges against three persons, including Sharma, Gajendra Singh and Jain after the audio clips went viral.

"I had lodged a complaint with the Special Operations Group (SOG) after audio recordings went viral on social media to investigate the matter. FIR has been registered but I am yet to receive its copy," he said.

"Earlier also I had lodged a complaint and several questions were raised about evidences and delay in probe but audio recordings are now a proof. Those talking in audio recording should be identified and arrested," he added.

The SOG has so far registered three FIRs based on complaints of alleged horse trading of legislators.

A division bench of the Rajasthan High Court on Friday began hearing a petition filed by Sachin Pilot and 18 other dissident Congress MLAs, challenging the disqualification notices issued by the assembly Speaker. Special Operations Group (SOG) on Friday lodged two FIRs over purported audio clip about conspiracy to topple Rajasthan Government. The identities of the accused are still unknown.

"Authenticity of the audio clip will be probed first," Ashoke Rathore, ADG SOG said, adding that, "We registered 2 FIRs under section 124A and 120B. The veracity of clip to be investigated."

He also said, "Sanjay Jain was interrogated yesterday, he was called today also. Presently we are trying to ascertain some facts from him."

In the audiotapes that surfaced in media a while ago, several leaders were purportedly heard discussing luring MLAs from the Ashok Gehlot camp to Sachin Pilot's side.

Meanwhile, Congress party's chief whip Mahesh Joshi is scheduled to appear before the Rajasthan HC for recording his statement.

Cong to file FIR against Gajendra Singh Shekhawat for involvement in poaching of MLAs to topple Gehlot govt

Rajasthan Congress chief whip Mahesh Joshi on Friday said that the party is planning to file a case against Union Cabinet minister Gajendra Singh Shekhawat for his alleged involvement in poaching MLAs to topple Rajasthan government.

"I have complained to Special Operations Group (SOG) seeking an investigation, registration of case and appropriate action," Joshi said.

Notably, Congress has suspended Sharma and another MLA Vishvendra Singh from the primary membership of the party for their alleged involvement in horse-trading of MLAs and demanded registration of a case against them.

Congress suspends MLAs Bhanwar Lal Sharma, Vishvendra Singh; issues show-cause notice to them

The Congress party on Friday suspended MLAs Bhanwar Lal Sharma and Vishvendra Singh from the primary membership of the party.

This development was announced by party spokesperson Randeep Singh Surjewala.

"The party has also issued show-cause notices to them," he said.

Surjewala demanded the Rajasthan government and Special Operations Group to register an FIR and arrest culprits, adding that plenty of evidence has surfaced now.

Conveying Congress party's demands, he also said that Sachin Pilot should come forward and make his stand public on the allegations of providing MLAs' list to BJP.

He was referring to audiotapes aired in the media in which Union Minister Gajendra Singh Shekhawat, BJP leader Sanjay Jain & Congress MLA Bhanwar Lal Sharma spoke about bribing MLAs and bringing down Rajasthan government.

"I demand that an FIR is registered by SOG against Union Minister Gajendra Singh Shekhawat & a probe is initiated into the tape. If it is suspected that he could influence the probe, then a warrant should be issued & he should be arrested immediately," he said.

He further added, "We also demand that Congress MLA Bhanwar Lal Sharma and BJP leader Sanjay Jain should also be booked. It should also be probed as to who arranged the 'black money' to bribe MLAs & who were given the bribe."

Top Cong leadership still wants to keep 'doors open' for Sachin Pilot: Sources

Even as a section of leaders within the Congress feels that Sachin Pilot has 'gone too far', especially after he took the party to court over the disqualification issue, sources on Thursday said the top party leadership is still keeping the 'doors open' for the rebel leader and has also asked Rajasthan chief minister Ashok Gehlot to not make critical comments against his former deputy.

Sources also claimed that Pilot has spoken to a senior party leader from southern India on Thursday laying conditions for his return.

While there was no confirmation from the Pilot camp on this conversation, sources said Pilot was told unequivocally that the Congress party's 'doors are still open' for him, but he would have to return unconditionally.

He was also reportedly told that he would first have to come out of the 'BJP camp and not hobnob' with them.

According to sources, Pilot was also told that the Congress party is ready to forget this chapter and that he will be accorded equal respect on his return.

Rajasthan Chief Minister to brief media in Jaipur today

Rajasthan Chief Minister Ashok Gehlot is set to brief media in the morning at the hotel in Jaipur where Congress party MLAs are lodged.

The press briefing is scheduled to begin at 9 am at the Fairmont Hotel here.

On July 14, a Congress Legislature Party (CLP) meeting was held at the same hotel and MLAs supporting Ashok Gehlot have been staying in the hotel for days.

Rajasthan HC to hear Sachin Pilot, rebel MLAs' plea against disqualification notice today

A division bench of the Rajasthan High Court will hear the petition filed by Sachin Pilot and 18 rebel MLAs, challenging the notices from the Speaker over a Congress move to disqualify them from the state assembly today at 5 pm.

The petition first came up before Justice Satish Chandra Sharma at 3 pm on Thursday. But advocate Harish Salve sought time to file a fresh petition.

The matter was heard again at about 5 pm when the judge referred the fresh petition to a division bench.

The counsel to Congress chief whip Mahesh Joshi earlier said the court had asked the advocates to appear again before it at 7.30 pm.

But the court did not assemble for the hearing, which was put off. The postponement is a matter of concern for the dissident camp led by Pilot.

The notices say Speaker C P Joshi will take up the complaint filed against them by the Congress chief whip at 5 pm today, the time set by the high court for hearing their petition.

Pilot's comments on Raje's bungalow proof of his frustration: BJP MLAs

Sachin Pilot's statement about Rajasthan Chief Minister Ashok Gehlot being busy helping former chief minister Vasundhara Raje keep her official bungalow instead of fulfilling promises made in the election manifesto reflects his frustration, two BJP MLAs said on Thursday.

In a statement, the Bharatiya Janata Party (BJP) MLAs Kailash Maghwal and Pratap Singhvi highlighted that Raje had served as the chief minister of the state twice, was a five-time legislator and also the leader of the opposition.

Pilot, the former Rajasthan deputy chief minister had in an interview said that Gehlot was busy ensuring that Raje does not have to vacate her government bungalow.

"The bungalow is allotted to Vasundhara Raje as she is a senior MLA. Bungalows are allotted to senior MLAs from time to time," the legislators said in the statement.

"It is a reality that Sachin Pilot is hurt as Vasundhara Raje defeated his mother Rama Pilot in the 2003 Assembly election," they added.

As far as mines lease allotment is concerned, Pilot should know that allotment related probe was handed over to Lokayukta after complaints were lodged, they said.

Rajasthan health minister Raghu Sharma on Thursday reiterated that Chief Minister Ashok Gehlot had the support of 109 MLAs and that he would continue to lead the government.

Sharma claimed that 109 MLAs were in support of the government.

He accused the BJP of attempting to topple the government through horse-trading amid the coronavirus crisis.

Transport minister Pratap Singh Khachariyawas also accused the BJP of using the politics of horse-trading to bring down the elected government on the basis of money.

He said Congress MLAs should not betray the party.

We have won elections on Congress tickets and betraying the party is a sin, he said.

'Bhanwar Lal Sharma conspiring to topple govt'; MLA refutes CM Gehlot camp's claim

Senior Congress legislator Bhanwarlal Sharma, who is a Sachin Pilot loyalist, was on Thursday accused by his party members of making several attempts of toppling governments but never succeeding.

A statement, issued by the supporters of Rajasthan Chief Minister Ashok Gehlot, said that Sharma was making the fifth attempt to topple the government this time with rebel Congress leader Sachin Pilot.

"Former minister and MLA Bhanwarlal Sharma had attempted to topple the government in the 90s. This is his fifth attempt to topple the government but he never succeeded," the statement from Gehlot camp said.

Ashok Gehlot while being a union minister and PCC president that time had always objected to toppling BJP government and had said that horse-trading is not a tradition in Rajasthan," the statement said.

It further said when the then chief minister Bhairon Singh Shekhawat had gone to the US for heart surgery, Sharma had met Gehlot with the intention of overthrowing the state government.

However, Gehlot asked Sharma that conspiracy to topple the government led by a person who was in a foreign country for treatment was against morality, the statement said.

It claimed that Sharma had also distributed money to MLAs and that one of the MLAs even told Shekhawat that he was given Rs five lakh.

A seven-time MLA, Sharma was from Janata Dal at that time and he later joined Congress.

"That Bhanwarlal Sharma is again dreaming of forming a government with the help of BJP by being a part of Sachin Pilot's conspiracy," the statement alleged.

The statement was issued after audio clips surfaced in which Sharma is purportedly heard discussing with a union minister about luring MLAs from the Ashok Gehlot camp to Sachin Pilot's side.

Sharma, however, said the audio clips were fake.

"This is neither my voice nor did I talk. This is totally fake," Sharma, who is Sardarshaha (Churu) MLA, said in a video message.

Rajasthan Crisis: Special Rajasthan police team formed to probe audio tapes' conspiracy, make arrests

Jaipur: Sachin Pilot and 18 other dissident leaders on Thursday moved the high court, challenging the notices from the Rajasthan Speaker over a Congress move to disqualify them from the state assembly.

The matter is scheduled to be heard before a division bench of the Rajasthan High Court at 1 pm Friday, which is also the deadline that the Speaker's office gave the MLAs to file their replies to the notices.

Their petition first came up before the court of Justice Satish Chandra Sharma at about 3 pm. But the dissidents' advocate Harish Salve sought time to file a fresh plea.

At about 5 pm, the dissident camp submitted an amended petition and the court referred it Chief Justice Indrajit Mahanty, for the appointment of a two-judge bench.

Congress chief whip Mahesh Joshi's counsel said then that the matter will be heard at about 7.30 pm, but the bench did not assemble then.

The hearing has been put off to Friday, the counsel said. Top lawyers represent the two sides.

Abhishek Manu Singhvi, who is also a Congress leader, represents the Speaker's office. Harish Salve and Mukul Rohatgi, who have represented the BJP-led government at the Centre in the past, are the lawyers for the Pilot's camp.

The 19 MLAs were sent notices by the assembly secretariat on Tuesday and allowed up to Friday to give their replies. The notices said Speaker C P Joshi will take up the matter at 1 pm on Friday.

The notices were served after the ruling party complained to the Speaker that the MLAs had defied a party whip to attend two Congress Legislature Party meetings, on Monday and Tuesday.

The Pilot camp, however, argues that a party whip applies only when the assembly is in session.

In its complaint to the Speaker, the Congress sought action against Pilot and the other dissidents under paragraph 2 (1) (a) of the Tenth Schedule of the Constitution.

The provision disqualifies MLAs if they voluntarily give up the membership of the party which they represent in the House.

The Congress said in the letter to the Speaker that the Supreme Court has unequivocally held in the past that the provision comes into effect when the conduct of an MLA leads to this inference.

In his initial appearance, advocate Harish Salve argued that the MLAs wanted to challenge the constitutional validity of the notices and needed some time to file it afresh.

Among those sent notices are Vishvendra Singh and Ramesh Meena, who were sacked along with Pilot from the state cabinet after their rebellion against Ashok Gehlot. Pilot was also removed from the post of the state unit of the Congress.

Apart from the three sacked ministers, the other MLAs served notices are Prithviraj Meena, Ved Prakash Solanki, Suresh Modi, Deependra Singh, Bhanwar Lal Sharma, Gajraj Khatana, Indraj, Gajendra Singh Shaktawat, Hema Ram Chaudhary, Ram Niwas Gawriya, Amar Singh, Brijendra Singh Ola, Murari Lal, Mukesh Kumar Bhakar, Rakesh Parekh and Harish Meena.

The initial petition filed by the dissidents said Pilot has issued statements saying he has no intention of leaving the Congress.

It argued that that the show cause notice is contrary to the Rajasthan Legislative Assembly (Disqualification) Rules, which allows seven days to file a reply.

It said no action has been taken by the Speaker on a similar complaint, alleging defection by Bahujan Samaj Party members, since it was filed 10 months back.

Sachin Pilot has been upset since the Congress picked Ashok Gehlot for the chief minister's post after the 2018 assembly polls. His supporters said he deserved credit for the party's victory election after a campaign helmed by him as its state unit chief.

If the 19 Congress dissidents are disqualified, the current strength of the state assembly will reduce to 181, slashing the half-way mark to 91 and seemingly making it easier for Chief Minister Ashok Gehlot to retain majority support.

In the 200-member assembly, the Congress has 107 MLAs and the BJP 72.

In the past, the ruling party has claimed the support of 13 independents, two MLAs each from the CPM and the Bhartiya Tribal Party (BTP), and one from the Rashtriya Lok Dal (RLD). PTI CORR SDA
