3 accused acquitted in Palakkad rape case; Contradiction in statements of eye witness

A Special Court last week acquitted the three accused in the alleged sexual assault and murder of two minor girls in Walayar in 2017. The court said that there were contradictions in the statements of eye witness accounts of the stepfather and mother of the victim.

Palakkad: Three accused in the rape and death case of Walayar sisters were acquitted on October 25. The copies of the judgment were released on Friday by the First Additional Sessions Court.

The police had arrested three men identified as V Madhu, Shibu and M Madhu in the case and charged them under various Sections of the Protection of Child against Sexual Offenses (POCSO) Act.

The 13-year-old minor girl had allegedly committed suicide in January 2017 while the younger girl was found dead almost two months later. The post mortem had found that both the girls were subjected to sexual assault.

The court said that there were contradictions in the statements of eye witness accounts of the stepfather and mother of the victim. In their initial statements given to the police, they had not mentioned about them witnessing the sexual abuse of the victim by the accused.

According to the judge, it was only in the statements recorded by the new investigating officer, who took over the probe after the death of the second girl in March 2017, that they mentioned about the sexual abuse by the accused.

The Court did not take into account their explanation that they had suppressed the incident out of concern for the welfare of the girl.
