Babulal Marandi served notice again for violation of anti-defection law

Babulal Marandi is again served a notice by the speaker for violation of the anti-defection law under the 10th schedule on the complaint filed by MLA Bhushan Tirkey. On 17 December, the HC had put an interim stay on the earlier notice of the speaker and set the next date of hearing on 13 January.

Ranchi: Bharatiya Janata Party (BJP) leader Babulal Marandi is again served a notice by the speaker for violation of the anti-defection law following the Jharkhand High Court's stay on the earlier notice.

Babulal Marandi had approached the Jharkhand High Court against the earlier notice received by the speaker. On 17 December, the HC put an interim stay on the notice of the speaker and set the next date of hearing on 13 January, seeking answers from all the parties.

This time the speaker has issued a notice to Marandi under the 10th schedule on the complaint filed by MLA Bhushan Tirkey.

Babulal Marandi has been asked why action should not be taken against him under the defection law?

Earlier, notice was given to Babulal Marandi by the Jharkhand Assembly Speaker taking suo motu cognizance that the HC stayed on December 17. It ruled that the Speaker did not have the right to issue a notice by taking cognizance in the 10th schedule.

Only on the complaint of a member, a notice can be issued.

Jharkhand Assembly Speaker Rabindra Nath Mahato, in November, had issued show-cause notices to Marandi, Pradeep Yadav and Bandhu Tirkey questioning their merger claims under the Tenth Schedule of the Constitution.

Following this, a case regarding the violation of the 10th schedule of the Constitution was lodged against Marandi and two other JVM(P) MLAs Pradeep Yadav and Bandhu Tirkey.
