Late actor Sushant Singh Rajput's father KK Singh on Saturday (August 8) moved the Supreme Court filing a counter-affidavit against the plea of Rhea Chakraborty, in which the actress urged the top court to transfer the case from Patna to Mumbai. Singh, 74, stated in the affidavit that since the investigation into the FIR has already been transferred to the CBI, Rhea's plea seeking transfer of probe to Mumbai stands 'infructuous'.

New Delhi: Late actor Sushant Singh Rajput's father has told the Supreme Court that Rhea Chakraborty's petition seeking transfer of case from Patna to Mumbai is not maintainable as the case has already been taken over by Central Bureau of Investigation (CBI).

The affidavit has been filed by SSR's father, KK Singh, in response to the top court's directions to all the parties in the matter to file their responses in three days.

He has contended before the court that Rhea's petition has become infructuous now, as on the Bihar government's recommendation the case has been transferred to the CBI and the investigation is ongoing.

Adding further he said that even Rhea wanted a CBI probe as per her social media post wherein she had requested Home Minister Amit Shah to initiate a CBI enquiry to understand the circumstances under which the late actor took his life.

Criticising Mumbai police, K K Singh said that Mumbai police did not cooperate with the Patna police officers by quarantining them contrary to the guidelines of the quarantine in Mumbai. They were also informed about the apprehension of threat to life to the late actor but the police did not take any action and even after the demise of the actor, Mumbai police showed no urgency in finding the culprits.

In the name of enquiry they conducted an "eyewash" which is clear from the fact that Rhea, who was in life in with the actor, was interrogated after 4 days of death, witnesses who do not lie in the ambit and scope of the investigation were examined etc.

The affidavit further read that the Mumbai police's investigation is limited to ascertain the cause of death and can not continue for an indefinite period. The possibility of tampering with evidence can also be not ruled out.

The matter is listed for hearing in the Supreme Court on August 11.
