He along with Justice Madan B Lokur, Kurien Joseph and Justice Chelameswar had called a press conference to level allegations against the then CJI Deepak Misra for bench fixing. Later on, he was accused in a sexual harassment case by a court's staff where he was given a clean chit by the top court.

However, the woman who had levelled charges against him has been reinstated in the court which has raised doubts over the clean chit given to Gogoi. The Ayodhya verdict given by him in favour of Hindus was criticised and later on, his appointment as an RS member within 4 months of his retirement had also raised a lot of eyebrows.

He has presided over many landmark cases like Rafale, scrapping of Article 370, National Register of Citizens, etc.
