Home secy meets Amulya Patnaik to take stock of law, order situation

Union Home Secretary Ajay Kumar Bhalla on Tuesday met Commissioner of Delhi Police Amulya Patnaik to take a stock of law and order situation in the national capital.

The review meeting comes after the protests against the Citizenship Amendment Act turned violent in the Seelampur area.

Several protests have been held against the citizenship act in several parts of the national capital, including Jamia Milia Islamia University and Delhi University.

Twenty-one people, including 12 police personnel and 3 from Rapid Action Force, sustained injuries during protests against the amended Citizenship Act in Seelampur, Joint Commissioner of Delhi Police Alok Kumar said.

He said that five persons have been detained and two police booths have been damaged and no lathi-charge was done by the police.

Earlier in the day, the Joint Commissioner said that no bullet was fired and only tear gas shells were used.

"2 public transport buses, 1 Rapid Action Force bus and some bikes were damaged during the protest," he said. 

Delhi Police's Public Relations Officer (PRO), MS Randhawa has also said that the situation in the region is under control now. 

"The situation in the Seelampur area is under control now. I appeal to the people of Delhi to maintain peace and not heed to the rumours or false information being spread on social media," he said. 

"We are taking CCTV footage from areas where any incident is taking place. Video recording is also being done. None of the people, involved in such incidents, will be spared,' he added.

Ex Cong MLA named in FIR on Jamia violence

Former Congress MLA Asif Khan has been named as an accused in the FIR, for involvement in Jamia Millia Islamia incident that took place on 15 December, said Delhi police on Tuesday.

The ex-MLA has been named along with six other accused, they said. 

The other six accused persons have been identified as local politicians Ashu Khan, Mustafa and Haider, AISA member Chandan Kumar, SIO member Asif Tanha, and CYSS member Kasim Usmani, police said.

The situation in the Seelampur area of New Delhi, where violent protests broke out against the Citizenship (Amendment) Act 2019 on Tuesday, is under control now, Delhi police said, adding that they are keeping a close watch in the area.

"The situation in the Seelampur area is under control now. I appeal to the people of Delhi to maintain peace and not heed to the rumors or false information being spread on social media," said Delhi Police's Public Relations Officer (PRO), MS Randhawa.

"We are taking CCTV footage from areas where any incident is taking place. Video recording is also being done. None of the people, involved in such incidents, will be spared,' he added.

Delhi court sends 10 people arrested for CAA protests to judicial custody till Dec 31

Delhi's Saket court on Tuesday sent 10 people, arrested in connection with the protests against Citizenship Amendment Act (CAA) near Jamia Millia Islamia University here, to judicial custody till December 31.

Metropolitan Magistrate Kamran Khan earlier sent six of the 10 arrested people -- Mohammad Hanif, Danish alias Jafar, Sameer Ahmed, Dilshad, Shareef Ahmed, Mohd Danish -- to judicial custody after police sought their custodial interrogation for 14 days.

The court after a while also sent the other four --Yunus Khan, Jumman, Anal Hassan, Anwar Kala -- to judicial custody.

Police had on Monday arrested them for their alleged involvement in the violence near Jamia Millia Islamia University in Delhi, it had said, adding that none of them was a student.

The two persons admitted in Safdarjung Hospital were admitted on their own and the type of injury these people have suffered is yet to be known," said sources from Delhi police.

They also informed that a CAA protest was scheduled in North East Delhi, Jaffarabad at 2 pm today. People gathered around 1:15 pm & marched towards Seelampur from there. These protests were initially peaceful, but a sudden outbreak of violence emerged while they were dispersing.

Supreme Court on Jamia Millia Islamia and AMU incidents case said: "Having regard to the nature of the matter and the vast disputed area, we find it would be feasible to appoint a single committee to go into the matter in different states. This will entail collection of evidence from various states."

Supreme Court asked petitioners to approach High Court within the jurisdiction of incidents where protest against Citizenship Amendment Act took place. 

Supreme Court said: "Concerned High Courts will be at liberty to appoint former judges of Supreme Court or High Court for the purpose of inquiry after hearing Centre and the respective States."

Hearing on Jamia Millia Islamia and Aligarh Muslim University case is underway in Supreme Court on Tuesday. The hearing is presented before the bench headed by Chief Justice of India, Sharad Arvind Bobde.

Putting forward their perspective Counsel appealed: "There was widespread discontent among people of India, it was perceived as anti-Muslim bill....the protest erupted first in North East. The students of Jamia Aligarh also protested. Seige was laid in the universities...SC has to intervene."

Chief Justice of India SA Bodbe said: "We are telling you that each of the incidents has happened at different places, different steps have been taken by different authorities...you ought to know the facts....we are not saying that you should not be heard. He says that understand the legal procedure, why they didn't go to the High Courts."

While hearing the Jamia Millia Islamia and Aligarh Muslim University incidents case on Tuesday, the Supreme Court said: " We do not have to intervene. It is a law and order problem, how did the buses burn? Why don’t you approach jurisdictional High Court?"

Counsel said: "Protests are being held across the country and they are increasing by the hour. If the Supreme Court does not intervene, the situation will escalate. The government wants to portray it in a different manner. Violence is not happening."

CJI Bobde questioned: "How did the buses burn?"

Counsel stated: "That will be found out in enquiry."

CJI Bobde asserted: "We are saying that prepare the facts and then present to us."

Counsel said: " Government has vested interest in showing it bad manner."

CJI Bobde: "We are not telling you that there is no problem, its not serious. All we are saying that go to HC and ascertain the facts. That we are not taking a stand on government"

Counsel for Vaibhav Mishra said: "FIRs are being fired one after the other against the students. If you want peace you can not file hundreds of FIRs and throw them in prison."

CJI Bobde: "If the police are saying that law has been broken, then they would not file the FIR? Someone is throwing a stone."

Meanwhile, Counsel Indira Jainsing said: "The established law is that Private party, the police can not trespass without the permission of VC. It is the duty of the state to provide medical aid, the court has also held that. Even private hospitals have to provide emergency aid. We have been getting calls since yesterday please collect the money we have to go home. The university closed before the scheduled date...what should the children do? They should sleep on the streets? They should stay in the hostels.

Indira Jaising appearing for students said: "It's established a law that universities are not a place where police can enter without permission of VC. 1 person lost eyesight. Legs of some students were broken."

Solicitor General, T Mehta replies, "not a single student lost eyesight."

Indira Jaising appearing for students in Jamia Millia Islamia and Aligarh Muslim University incidents case said: "It is a cross-state issue and needs a fact-finding SIT. How can the court wash its hands of the issue? Court heard Telangana encounter case. We are asking for a similar order."

Chief Justice of India, Sharad Arvind Bobde said: "The Telangana encounter case could be looked into by appointing a commission but in this case, there is no committee that can look into it all over the country."

CJI Bobde: "We are not saying that you do not have a problem

Counsel Indira Jainsing said: "Whichever agency is appointed must inspire the confidence of the student's community. Retired SC does inspire confidence."

Jamia crackdown: 11 Delhi Police officers transferred

Following the police crackdown against students in Jamia Millia Islamia, several Delhi Police officers, including Additional Police Commissioner of South-Eastern district Kumar Gyanesh have been transferred.

The names of 10 more Delhi Police officers were also included in the transfer list released by the Home Department of the Delhi government on Monday. However, Delhi Police headquarters said that the transfers were "routine" ones.

Information to this effect has been issued on Monday by the Deputy Secretary of the Home Department of the government of Delhi. A total of 11 officers: five IPS and six officers from DANIPS service of Delhi Police were mentioned in the transfer order issued.

According to the order, among the 2010 batch IPS officers, Brijendra Kumar Yadav has been removed from DCP security and sent as Additional DCP-1 North West District. Pratap Singh, an IPS officer from 2011 batch, has been removed from the post of Additional DCP-1 in South-West District and sent to South-Eastern District.

While in the south-eastern district, Kumar Gyanesh, Additional DCP-1, DANIPS service, has been removed and posted in South-West district in place of Pratap Singh.

It is noteworthy that Kumar Gyanesh was the additional DCP-1 when the violence took place in the Jamia Nagar and Jamia Millia Islamia on Sunday. Delhi Police insiders say that after the incident, Delhi Police removed him from the district with immediate effect to thwart questions being raised against it.

Similarly, 2011-batch IPS officer Shankar Chaudhary has been removed as Additional DCP-PCR and given the charge of DCP-Traffic.

Abhishek Dhania, a 2012-batch IPS officer, has been moved from DCP-Traffic and sent as Additional DCP-1 Eastern District. Vikram Harimohan Meena (2015 batch IPS) has been moved from Additional DCP South-West District to DCP-Traffic.

The first name in the list of 6 DANIPS officers transferred is Suman Nalwa, a 1996-batch officer. She has been moved from the Principal of Police Training School, Dwarka and sent as DCP Special Branch (Intelligence Branch). Whereas Bhishma Singh, a 1997-batch DANIPS officer, has been moved from Additional DCP-1 North-West district to DCP Cyber (Crime Branch).

Sushil Kumar Singh, a 2006-batch DANIPS officer, was posted as Additional DCP-2 North West Delhi District. He has been made the additional DCP of the Security Wing. Similarly, 2009-batch DANIPS officer Pawan Kumar is now Additional DCP (Prime Minister's Security). Whereas Sandeep Bayala of 2009 batch, who was the Additional DCP (Prime Minister's Security) till now, will be the Additional DCP-Police Control Room.

As per preliminary investigation of the Jamia students protests in Delhi, police stated that the protest did not seem to be spontaneous but well planned as some protesters were carrying wet blankets and putting them on tear gas shells to minimize their impact.

Police also maintained that Petrol bombs were also hurled at them by the protesters. 

It shows that it was a conspiracy as these things do not happen on the spot, police added.

Several vehicles, including buses, were burnt down and public properties destroyed during the protests against the Citizenship Amendment Act, which was passed by Parliament last week.

According to the Act, members of Hindu, Sikh, Buddhist, Jain, Parsi and Christian communities who have come from Pakistan, Bangladesh and Afghanistan till December 31, 2014 and facing religious persecution there will not be treated as illegal immigrants but given Indian citizenship.

The Act says refugees of six communities will be given Indian citizenship after residing in India for five years, instead of 11 years earlier.

Stressing on the ongoing protests in the country over the Citizenship (Amendment) Act 2019, (CAA), Vice President M Venkaiah Naidu said that violence is not the solution to any problem.

 "There shouldn't be any obstruction or destruction, everybody should focus on construction. And our attitudes must change after all we are in free India, our own India. If you are destroying, means you are destroying the nation's wealth," he said.

"The other day some public transport has been destroyed. Who are the losers? It's the people and the country. So, while agitating for our cause, one must be systematic. It shouldn't become destructive. Violence is no solution," he added.

Protests have taken place in several parts of the country over the CAA, which received Presidential assent last week after the Citizenship (Amendment) Bill, 2019 was passed by the Parliament.

No bullet fired by police during protests at Jamia: MHA officials

No bullet was fired by police during violent protests against the amended Citizenship Act at Jamia Milia Islamia University on Sunday, Home Ministry officials said.

There have been allegations that police fired bullets on protesters during the agitation at Jamia.

The officials also said that no student has been arrested and 10 people with criminal background have been detained in connection with the protests and more anti-social elements are being tracked.        

"No bullet was fired by the Delhi Police during protests at Jamia. All 10 persons detained have a criminal background. More anti-social elements are being tracked," the officials said, citing a Delhi Police report.

CAA stir continues: Protest turns voilent in Delhi's Jafrabad

New Delhi: Protesters, including students and local residents, converged outside Jamia Millia Islamia University here with tricolour and placards on Tuesday to continue their demonstration against the Citizenship Amended Act and National Register of Citizens.

Braving freezing cold, they took out small marches outside the varsity, shouting slogans against the government.

They, however, made sure the movement of traffic was not affected.

A few students said though many of their classmates have gone back home, they have decided to stay back and fight till the amendments in the Citizenship Act are withdrawn.

This is the second consecutive day of peaceful protests after the demonstration on Sunday turned violent.

On Monday, thousands of students took to the streets demanding a probe into the use of teargas on Sunday inside the Jamia university's library as well as police entering the campus without permission from university authorities.

Scores of protesters including Jamia students, policemen and locals were injured, four DTC buses were torched and over 100 private vehicles and 10 police bikes were also damaged in the violence and arson that took place during the protest on Sunday.

Women from all age groups, including grandmothers and sisters of students, were seen taking the lead in the protest on Monday, vowing to continue the fight for justice till their "last breath".

Residents and parents of students from nearby areas came out in numbers to support them.

Frequent protests by the students of Jamia Millia Islamia against the CAB and NRC  continues on Tuesday as they were seen protesting at the number 7 gate. 

Students gathered at the gate number 7 and staged demonstrations without disturbing the traffic.

Supreme Court on Jamia Millia Islamia and AMU incidents case said: "Having regard to the nature of the matter and the vast disputed area, we find it would be feasible to appoint a single committee to go into the matter in different states. This will entail collection of evidence from various states."

Supreme Court asked petitioners to approach High Court within the jurisdiction of incidents where protest against Citizenship Amendment Act took place. 

Supreme Court said: "Concerned High Courts will be at liberty to appoint former judges of Supreme Court or High Court for the purpose of inquiry after hearing Centre and the respective States."

Approach the High Court first: SC

Hearing on Jamia Millia Islamia and Aligarh Muslim University case is underway in Supreme Court on Tuesday. The hearing is presented before the bench headed by Chief Justice of India, Sharad Arvind Bobde.

Putting forward their perspective Counsel appealed: "There was widespread discontent among people of India, it was perceived as anti-Muslim bill....the protest erupted first in North East. The students of Jamia Aligarh also protested. Seige was laid in the universities...SC has to intervene."

Chief Justice of India SA Bodbe said: "We are telling you that each of the incidents has happened at different places, different steps have been taken by different authorities...you ought to know the facts....we are not saying that you should not be heard. He says that understand the legal procedure, why they didn't go to the High Courts."

While hearing the Jamia Millia Islamia and Aligarh Muslim University incidents case on Tuesday, the Supreme Court said: " We do not have to intervene. It is a law and order problem, how did the buses burn? Why don’t you approach jurisdictional High Court?"

Counsel said: "Protests are being held across the country and they are increasing by the hour. If the Supreme Court does not intervene, the situation will escalate. The government wants to portray it in a different manner. Violence is not happening."

CJI Bobde questioned: "How did the buses burn?"

Counsel stated: "That will be found out in enquiry."

CJI Bobde asserted: "We are saying that prepare the facts and then present to us."

Counsel said: " Government has vested interest in showing it bad manner."

CJI Bobde: "We are not telling you that there is no problem, its not serious. All we are saying that go to HC and ascertain the facts. That we are not taking a stand on government"

Counsel for Vaibhav Mishra said: "FIRs are being fired one after the other against the students. If you want peace you can not file hundreds of FIRs and throw them in prison."

CJI Bobde: "If the police are saying that law has been broken, then they would not file the FIR? Someone is throwing a stone."

Meanwhile, Counsel Indira Jainsing said: "The established law is that Private party, the police can not trespass without the permission of VC. It is the duty of the state to provide medical aid, the court has also held that. Even private hospitals have to provide emergency aid. We have been getting calls since yesterday please collect the money we have to go home. The university closed before the scheduled date...what should the children do? They should sleep on the streets? They should stay in the hostels.

Indira Jaising appearing for students said: "It's established a law that universities are not a place where police can enter without permission of VC. 1 person lost eyesight. Legs of some students were broken."

Solicitor General, T Mehta replies, "not a single student lost eyesight."

Indira Jaising appearing for students in Jamia Millia Islamia and Aligarh Muslim University incidents case said: "It is a cross-state issue and needs a fact-finding SIT. How can the court wash its hands of the issue? Court heard Telangana encounter case. We are asking for a similar order."

Chief Justice of India, Sharad Arvind Bobde said: "The Telangana encounter case could be looked into by appointing a commission but in this case, there is no committee that can look into it all over the country."

CJI Bobde: "We are not saying that you do not have a problem

Counsel Indira Jainsing said: "Whichever agency is appointed must inspire the confidence of the student's community. Retired SC does inspire confidence."

CJI Bobde: "That Chief Justice of High Court can also do."

Jamia crackdown: 11 Delhi Police officers transferred

Following the police crackdown against students in Jamia Millia Islamia, several Delhi Police officers, including Additional Police Commissioner of South-Eastern district Kumar Gyanesh have been transferred.

The names of 10 more Delhi Police officers were also included in the transfer list released by the Home Department of the Delhi government on Monday. However, Delhi Police headquarters said that the transfers were "routine" ones.

Information to this effect has been issued on Monday by the Deputy Secretary of the Home Department of the government of Delhi. A total of 11 officers: five IPS and six officers from DANIPS service of Delhi Police were mentioned in the transfer order issued.

According to the order, among the 2010 batch IPS officers, Brijendra Kumar Yadav has been removed from DCP security and sent as Additional DCP-1 North West District. Pratap Singh, an IPS officer from 2011 batch, has been removed from the post of Additional DCP-1 in South-West District and sent to South-Eastern District.

While in the south-eastern district, Kumar Gyanesh, Additional DCP-1, DANIPS service, has been removed and posted in South-West district in place of Pratap Singh.

It is noteworthy that Kumar Gyanesh was the additional DCP-1 when the violence took place in the Jamia Nagar and Jamia Millia Islamia on Sunday. Delhi Police insiders say that after the incident, Delhi Police removed him from the district with immediate effect to thwart questions being raised against it.

Similarly, 2011-batch IPS officer Shankar Chaudhary has been removed as Additional DCP-PCR and given the charge of DCP-Traffic.

Abhishek Dhania, a 2012-batch IPS officer, has been moved from DCP-Traffic and sent as Additional DCP-1 Eastern District. Vikram Harimohan Meena (2015 batch IPS) has been moved from Additional DCP South-West District to DCP-Traffic.

The first name in the list of 6 DANIPS officers transferred is Suman Nalwa, a 1996-batch officer. She has been moved from the Principal of Police Training School, Dwarka and sent as DCP Special Branch (Intelligence Branch). Whereas Bhishma Singh, a 1997-batch DANIPS officer, has been moved from Additional DCP-1 North-West district to DCP Cyber (Crime Branch).

Sushil Kumar Singh, a 2006-batch DANIPS officer, was posted as Additional DCP-2 North West Delhi District. He has been made the additional DCP of the Security Wing. Similarly, 2009-batch DANIPS officer Pawan Kumar is now Additional DCP (Prime Minister's Security). Whereas Sandeep Bayala of 2009 batch, who was the Additional DCP (Prime Minister's Security) till now, will be the Additional DCP-Police Control Room.

WATCH: Delhi Police Joint CP appealed Jamia Millia Islamia students to stay calm and stop stone pelting, on 15th December.

As per preliminary investigation of the Jamia students protests in Delhi, police stated that the protest did not seem to be spontaneous but well planned as some protesters were carrying wet blankets and putting them on tear gas shells to minimize their impact.

Police also maintained that Petrol bombs were also hurled at them by the protesters. 

It shows that it was a conspiracy as these things do not happen on the spot, police added.

Several vehicles, including buses, were burnt down and public properties destroyed during the protests against the Citizenship Amendment Act, which was passed by Parliament last week.

According to the Act, members of Hindu, Sikh, Buddhist, Jain, Parsi and Christian communities who have come from Pakistan, Bangladesh and Afghanistan till December 31, 2014 and facing religious persecution there will not be treated as illegal immigrants but given Indian citizenship.

The Act says refugees of six communities will be given Indian citizenship after residing in India for five years, instead of 11 years earlier.

Stressing on the ongoing protests in the country over the Citizenship (Amendment) Act 2019, (CAA), Vice President M Venkaiah Naidu said that violence is not the solution to any problem.

 "There shouldn't be any obstruction or destruction, everybody should focus on construction. And our attitudes must change after all we are in free India, our own India. If you are destroying, means you are destroying the nation's wealth," he said.

"The other day some public transport has been destroyed. Who are the losers? It's the people and the country. So, while agitating for our cause, one must be systematic. It shouldn't become destructive. Violence is no solution," he added.

Protests have taken place in several parts of the country over the CAA, which received Presidential assent last week after the Citizenship (Amendment) Bill, 2019 was passed by the Parliament.

No bullet fired by police during protests at Jamia: MHA officials

No bullet was fired by police during violent protests against the amended Citizenship Act at Jamia Milia Islamia University on Sunday, Home Ministry officials said.

There have been allegations that police fired bullets on protesters during the agitation at Jamia.

The officials also said that no student has been arrested and 10 people with criminal background have been detained in connection with the protests and more anti-social elements are being tracked.        

"No bullet was fired by the Delhi Police during protests at Jamia. All 10 persons detained have a criminal background. More anti-social elements are being tracked," the officials said, citing a Delhi Police report.

CAA stir continues: Protest turns voilent in Delhi's Jafrabad

New Delhi: Protesters, including students and local residents, converged outside Jamia Millia Islamia University here with tricolour and placards on Tuesday to continue their demonstration against the Citizenship Amended Act and National Register of Citizens.

Braving freezing cold, they took out small marches outside the varsity, shouting slogans against the government.

They, however, made sure the movement of traffic was not affected.

A few students said though many of their classmates have gone back home, they have decided to stay back and fight till the amendments in the Citizenship Act are withdrawn.

This is the second consecutive day of peaceful protests after the demonstration on Sunday turned violent.

On Monday, thousands of students took to the streets demanding a probe into the use of teargas on Sunday inside the Jamia university's library as well as police entering the campus without permission from university authorities.

Scores of protesters including Jamia students, policemen and locals were injured, four DTC buses were torched and over 100 private vehicles and 10 police bikes were also damaged in the violence and arson that took place during the protest on Sunday.

Women from all age groups, including grandmothers and sisters of students, were seen taking the lead in the protest on Monday, vowing to continue the fight for justice till their "last breath".

Residents and parents of students from nearby areas came out in numbers to support them.
