AgustaWestland: SC stays HC order allowing Rajeev Saxena to travel abroad

The SC on Wednesday stayed the Delhi High Court's order allowing AgustaWestland chopper scam accused-turned-approver Rajeev Saxena to travel abroad for medical reasons. The bench asked the director of AIIMS to examine Saxena's mental and physical health and file a report.

New Delhi: The Supreme Court on Wednesday stayed a Delhi High Court order permitting Rajeev Saxena, an approver in a money laundering case related to the AgustaWestland chopper scam, to go abroad for treatment of blood cancer and other ailments.

A vacation bench comprising Justices Sanjiv Khanna and B R Gavai also issued a notice to Saxena on an appeal filed by the Enforcement Directorate (ED) challenging the June 10 Delhi High Court order permitting him to visit the United Arab Emirates, the United Kingdom and Europe from June 25 to July 24.

The bench, which stayed the High Court order for three weeks, also asked the director of AIIMS to examine Saxena's mental and physical health and file a report within three weeks.

It also directed Saxena's counsel to seek instruction on whether his sister and sister-in-law were willing to stand surety for him by depositing Rs 5 crore each as guarantee for allowing him to go abroad for treatment of blood cancer and other ailments.

Solicitor General Tushar Mehta, appearing for the ED, said certain new facts with regard to other offences have come to light and the CBI is formally going to register an FIR against Saxena shortly.

He said the question of whether Saxena would return to India or not has become immaterial and the order permitting him to go abroad needed to be examined in the light of fresh facts.

Intro:The Supreme Court today stayed the order of allowing Agusta Westland Chopper scam accused, Rajeev Saxena, to travel abroad for treatment of his blood cancer and other ailments. The advocate appearing for ED contended that doctors who had treated him certified that Saxena could be treated under him.


Body:The bench comprising, Sanjiv Khanna and BR Gavai observed that new facts have come up by Solicitor General, Tushar Mehta, appearing for ED, regarding violation of black money law. The bench also directed to constitute a medical board to be headed by Director General of AIIMS to examine his situation.

Yesterday when the matter was hear, the bench had asked if Saxena's sister and sister in law are ready to pay Rs5 crores each as the security and guarantee of his coming back. And on objection of ED of allowing him to travel abroad, the bench had asked if the government was incapable of bringing him back to the country.

On June 10th, the Delhi High Court had allowed Rajeev Saxena to travel abroad for his medical treatment saying that he has already been provided bail on his medical grounds before being pardoned and made an approver.
