SC refuses to entertain AAP MLA Devender Sehrawat's plea against disqualification

New Delhi: The Supreme Court on Friday refused to entertain a plea filed by Aam Aadmi Party (AAP) MLA Devender Sherawat challenging the disqualification notice served to him by the Delhi Assembly Secretariat under the anti-defection law.

The vacation bench comprising Justices Sanjiv Khanna and BR Gavai told Sehrawat's counsel that the lawmaker can raise his issues before the Assembly Speaker during the proceedings on the disqualification notice.

Thereafter, Sehrawat's counsel withdrew the petition.

Besides Sehrawat, another AAP MLA, Anil Bajpai, has also been served the notice after he joined the Bharatiya Janata Party (BJP).

The notice to Sehrawat was served after AAP leader and MLA Saurabh Bhardwaj approached the Delhi Assembly Speaker Ram Niwas Goel seeking disqualification of the two MLAs.

The party had moved a plea before the Delhi Assembly Secretariat seeking Sherawat's and Bajpai's disqualification under the anti-defection law.
Shehrawat and Bajpai were on Tuesday given a week's time by the Assembly Speaker to file their replies.

Sherawat is an MLA from Bijwasan Assembly constituency in Delhi.

Intro:The Supreme Court bench comprisng Justices Sanjiv Khanna and BR Gavai refused to entertain the petition filed by rebel Aam Admi Party MLA, Dewender Sherawat against the disqualification notice issued to him by the Delhi assembly secretariat.


Body:The SC felt that the petition is pre mature, there are facts involved in the matter which only the Speaker can get into and the court can not interfere at this stage. The hearing for the matter is already scheduled for 4rth july before the speaker and the court has asked the petitioner to make all.the submissions by 3rd july.

The court has recorded the statement of the petitioner's counsel.

Dewender Sherwat had joined BJP last month. Sherawat had said that the notice was illegal as he had still not joined BJP's primary membership.
On Tuesdays, the Delhi Assembly secretariat had issued a disqualification notice to Sherawat for joining BJP after AAP had complained about it. Sherawat is a MLA from Bijwasan. Along with him Anil Bajpai was also issued notice who is a MLA from Gandhi Nahar. The secretariat has given them a week's time to reply on the matter.
