Panel on Clause 6 of Assam Accord needs extension to submit report

In an exclusive interview to ETV Bharat, Justice (retd) Biplab Kumar Sarma, who is heading the high-level committee constituted for implementation of Clause 6 of the 1985 Assam Accord, said that the panel would require a week-10 days beyond January 15 - which is the last working day of the panel - to submit its report to the Union Home Ministry.

New Delhi: With the last working day of the high-level committee constituted for implementation of Clause 6 of the 1985 Assam Accord coming closer, retired Gauhati High Court judge Biplab Kumar Sarma, who is heading the panel, said that they are in the final stage of preparing the report and may require an extension of a week- 10 ten days to submit the report to the Home Ministry.

"Since our task is almost over, some minor corrections here and there are left to be done..we are in the final stage of the report.. we might need a week or ten days time beyond the deadline to complete the task," Sarma told ETV Bharat after meeting the Union Home Minister Amit Shah in New Delhi on Monday.

The meet called by Shah was attended by four of the 13 members of the panel, but was skipped by leaders of the All Assam Students’ Union (AASU), one of the signatories of the 1985 Assam Accord.

"We got a call from the Ministry of Home Affairs and during the meeting, various legal issues were discussed. We are yet to work on those issues, " said Sarma while elaborating on the purpose of the meeting.

When asked about the content of the report, the retired Judge said, "I cannot divulge the details of the report. As per the Terms of Reference, we have to discuss the issue with various stakeholders. We visited various places of Assam, covering almost all the districts, and spoke to various individuals, and organisations, and after taking their views into consideration we have prepared the report. Only minor things are left to be done."

On whether the panel has been able to define who is an 'Assamese', Sarma said, "That is in the report itself... but I cannot talk about these things now. Clause 6 says 'Assamese', we had to define that and identify Assamese people accordingly. We have worked out a definition."

The report of this committee assumes significance against the backdrop of the ongoing protest over the Citizenship (Amendment) Act (CAA). In fact, organisations spearheading the movement against CAA, have been demanding implementation of the committee's report.

When asked if he hopes that the report would bring some relief to those opposing CAA, Sarma said, "Our task is to spell out the measures that need to be adopted to safeguard the cultural heritage, etc. of the Assamese people. CAA is a different issue altogether."

The committee was assigned to hold discussions with all stakeholders and assess the required quantum of reservation of seats in Assam Legislative Assembly and local bodies for Assamese people.

It was also asked to assess the measures to be adopted to protect the Assamese and other indigenous languages of Assam, the quantum of reservation in employment under the government of Assam, among other things.

The committee has members including All Assam Students Union (AASU) leaders Samujjal Bhattacharya, Lurinjyoti Gogoi, Dipanka Kumar Nath, Assam advocate general, among others.

Joint Secretary (Northeast) in the Home Ministry Satyendra Garg is the member secretary of the committee.

Intro:New Delhi: The much hyped report of the public consultative committee on Clause 6 of the historic Assam Accord will be submitted to the Home Ministry by the end of this month.

The committee headed by Justice (retd) Biplab Sarma is at the final stage of compilation of the report.


Body:In an exclusive interview to ETV Bharat, Justice (retd) Sarma said that the committee members have visited across Assam and talked with all stakeholders.

"We have visited across Assam and talked with different people. During the last six months, we had discussion with political parties, citizens, academicians and all stakeholders and took their opinion...we have come today to take some more suggestions from the Home Ministry," said Sarma.

Sarma and a few other members of the committee had a meeting with Home Minister Amit Shah at his residence in New Delhi on Monday and discussed on the findings of the report.

"Although, I can't disclose the findings with the media right now, but we are at the final stage of the report," Sarma said.

The report of this committee assumes much more significance against the backdrop of the ongoing protest over Citizenship Amendment Act (CAA). In fact, organisations spearheading the movement against CAA, have been demanding implementation of the committee report before the government bring the CAA.

"We had some legal points discussed with the Home Minister. We need to take some more inputs from our committee members before we submit out report," said Sarma.

The Clause 6 of the Assam Accord talks about constitutional, legislative and administrative safeguards to the indeginious people of Assam.

The 13 member committee was reconstituted by the Union Cabinet in July last year. The panel was earlier setup in January last year. However, chairman of the panel MP Bezbarua (former Union Tourism Secretary) refused to be part of the panel.

The committee was assigned to submit a report in six months on the measures to protect, preserve and promote the cultural, social, linguistic identity and heritage of the Assamese people.

"It was not necessary that people who can speak Assamese are indeginious people...we have sorted out the definition of indeginious people and pointed out who are indeginious in Assam," said Sarma.

The committee was assigned to examine the effectiveness of actions since 1985 (when Assam Accord was signed) to implement Clause 6 of the Assam Accord.

The committee was assigned to hold discussions with all stakeholders and assess the required quantum of reservation of seats in Assam Legislative Assembly and local bodies for Assamese people.

The committee was also asked to assess the requirement of measures to be taken to protect Assamese and other indeginious languages of Assam, quantum of reservation in employment under government of Assam.



Conclusion:"We are likely to submit the report by the end of this month," said Sarma.

When asked whether this report will remove apprehension amongst the people of Assam over Citizenship Amendment Act (CAA), Justice (retd) Sarma said that their task was to compile report on the measure for the protection of identity and culture of the people of Assam.

"CAA is totally different and we did not worked onto," added Sarma.

The committee has members like All Assam Students Union (AASU) leaders Samujjal Bhattacharya, Lurinjyoti Gogoi, Dipanka Kumar Nath, Assam advocate general among others.

Joint Secretary (Northeast) in the Home Ministry Satyendra Garg is the member secretary of the committee.

Interestingly, Home Minister Amit Shah had earlier said that once the committee submit its report, Government will implement it.
