Pakistan Military Court's 2017 verdict on Jadhav may be annulled by ICJ, says former diplomat

Pakistan is not in a position to reject verdict of the International Court of Justice on Indian naval officer Kulbhushan Jadhav as its economy is in bad shape and it cannot afford to annoy the international community, says a former Indian diplomat.

New Delhi: Expressing hope for a possitive outcome in the Indian naval officer Kulbhushan Jadhav's case from the International Court of Justice (ICJ), former diplomat Achal Malhotra has said the court may pay heed to India's second request and annul the Pakistan Military Court's 2017 verdict which sentenced him to death.

Malhotra, who has also served in Vienna, termed India's first request to ICJ, as maximalist.
Achal also rejected the thought that Pakistan might ignore ICJ's verdict, citing the fragile economic situation of Pakistan and the international pressure the country is dealing with.

Kulbhushan Jadhav was allegedly arrested by Pakistan government in Balochistan on charges of terrorism and spying for India.

On April 10, 2017, Jadhav was sentenced to death by a Field General Court Martial in Pakistan but on 18 May 2017, the International Court of Justice stayed the execution pending the final judgement
in the case.

Intro:Talking about the prospects and possibilities of the verdict that can be given by the ICJ in the Kulbhushan Jadhav case, former diplomat Achal Malhotra who had also served in Vienna claimed that International Court of Justice may pay heed to India's second request and annul the Pakistan Military Court's 2017 verdict which sentenced Jadhav to death.


Body:On India's first request to the ICJ in which it not only demanded quashing of the Pakistan Military Court's 2017 verdict but also safe release and repatriation of the former Indian naval officer, the former diplomat called it maximalist.

Elaborating his point further, he said, 'the International Court of Justice may find it difficult to accede to this demand as the court has no merits to look into these allegations.'

Though he claimed that there is a high possibility that ICJ might consider India's second request while pronouncing its verdict.


Conclusion:'I personally feel that ICJ will annul Pakistan military court's 2017 verdict. A trial will take place in the civilian court and Jadhav will be provided a counselor access. As this seems more reasonable', claimed former diplomat Achal Malhotra.

On whether, Pakistan might ignore ICJ's verdict, Achal Malhotra called it an highly unlikely prospect. He emphasised on the fragile economic state of Pakistan and the international pressure its dealing with right now. He also talked about Financial Action Task Force's October deadline to take credible action against terror emanating from its soil.
