New Delhi: The Nirmohi Akhara on Monday moved an application in the Supreme Court seeking modification in the mediation order in Ayodhya case.
In the plea, the Nirmohi Akhara has sought the inclusion of two more retired judges in the mediation panel and also to shift the place of mediation from Faizabad to Delhi.
The Supreme Court, in its earlier order of mediation on March 8 had appointed the panel headed by former SC judge Justice F M Ibrahim Kalifulla. Besides Justice Kalifulla, the other members of the committee appointed to settle the Ram Janmabhoomi-Babri Masjid Ayodhya title dispute case are spiritual leaderSri Sri Ravi Shankar and senior advocate Sriram Panchu.
Supreme Court had also directed for complete ban on media reporting on the issue stating confidentiality issues.
The provision of referring the dispute to mediation is laid down in Section 89, Code of Civil Procedure which states, "Where it appears to the court that there exist elements of a settlement which may be acceptable to the parties, the court shall formulate the terms of settlement and give them to the parties for their observations and after receiving the observations of the parties, the court may reformulate the terms of a possible settlement and refer the same for (a) arbitration; (b) conciliation; (c) judicial settlement including settlement through Lok Adalat; or (d) mediation."
