Nirbhaya convict Mukesh moves SC again, seeks restoration of remedies

Mukesh Singh, one of the four convicts in the 2012 gangrape and murder case, has moved the Supreme Court on Friday seeking to quash all proceedings against him from December 6th, 2012 to March 3rd, 2020. In his petition, Mukesh has demanded to restore all his legal remedies including the curative plea.

New Delhi: One of the death row convicts in the Nirbhaya gangrape and murder case, Mukesh filed a petition in the Supreme Court on Friday seeking to quash all proceedings against him from December 6th 2012 to March 3rd, 2020.

The petition also demands to lodge criminal cases and CBI investigation against the counsel who appeared and filed petitions on his behalf accusing them of criminal breach of trust and criminal conspiracy. Mukesh also wants to restore all his legal remedies including the curative plea.

In a plea filed through Advocate ML Sharma, Mukesh Singh claims the limitation period to file a curative petition was three years from the date of dismissal of the review plea.

"Vrinda Grover who was appointed amicus curiae have no right to take Vakalatnama from the petitioner under false inducement stating the petitioner that Session court have directed her to file a curative petition and to represent him as his advocate in all the courts. Mukesh have no option and he signed various Valakatnama under pressure of the court," read the petition.

Yesterday a new death warrant was issued for hanging the convicts on 20th March at 5:30 am. The petition seeking separate hanging of the convicts was adjourned to 23rd March.

ML Sharma had criticised Vrinda Grover yesterday in open court as well and had seek to file an Intervention Application, but the court condemned his statements against Grover and asked him to file petition and not IA.
