If triple talaq is abolished, why make it a criminal offence: Abhishek Singhvi

National Spokesperson of the Congress party, Abhishek Manu Singhvi, has claimed that Congress did not oppose the bill as such but was against certain provisions in the proposed bill.

"If the Supreme Court has abolished the practice of triple talaq and legislations is also made in that regard, then why criminalise it?" he questioned.

Shayara Bano, who emerged as the face of the legal battle against the practice of Triple Talaq, spoke exclusively to ETV Bharat. She said, "Men will be scared of the law and will not indulge in the practice of instant divorce. The nation will finally be free from the practice of Triple Talaq."

"When I first filed the petition, I never knew it would gather so much attention," she added.

Shayara was the original petitioner in the case after she approached the court demanding that the talaq-e-biddat pronounced by her husband be declared as void. In 2017, the Supreme Court banned the practice, calling it unconstitutional.

India reacts to the passage of triple talaq bill

New Delhi: Amidst criticism from the Opposition in the Rajya Sabha, the triple talaq bill was passed with 99 'Ayes' and 84 'Noes,' bringing a formal end to the custom and criminalising instant divorce by Muslim men. 

It was the first draft legislation tabled by the Narendra Modi government in this first session after it took oath of office for a second term in May.

Several opposition parties have bitterly opposed it but the government had asserted that the bill is a step towards gender equality and justice. 

Parties like the Congress, the Trinamool Congress and the DMK had demanded that it be sent to a parliamentary committee for scrutiny.

It was passed by the 16th Lok Sabha but could not be passed in the Rajya Sabha hurdle.
