Gwalior: The Gwalior Bench of the Madhya Pradesh High Court has ordered the Director General of Police (DGP) to pay Rs 10 lakhs compensation to the youth for falsely arresting him under Narcotic Drugs and Psychotropic Substances (NDPS) Act and keeping him in jail for nine months. The police arrested the youth for possessing MDMA, a drug that was later found to be urea in the Forensic Science Laboratory (FSL) investigation.
According to sources, the Morar police of Gwalior arrested the youth on September 6, 2022, and claimed that 760 grams of MDMA were seized from his possession. It was claimed that the drug was brought for consumption at Gwalior's restaurants and pool parties at farmhouses. The Murar police then registered a criminal case against the youth Rohit Tiwari under Section 8/20 of the NDPS Act and seized the material recovered from him.

Rohit was then arrested and sent to jail. He then, through his counsel, filed a petition in the Gwalior bench of the High Court under Article 439 in this case and requested to present the FSL report of the seized material before the court. The High Court accepted the request and called for the report.
However, the FSL report revealed that the seized material was urea. Sunil Goswami, the lawyer of Rohit Tiwari, said that the High Court found in the investigation report that the materials seized from the youth were not drugs. The court accepted that Tiwari's liberty was violated by keeping him in custody for nine months, for which the DGP should give him Rs 10 lakhs as compensation. Along with this, instructions have been given to the investigating officers related to this case to ensure that such false cases are not registered in the future and that action should be taken against the guilty.
