SC stays its order to evict millions from forest lands

New Delhi: The Supreme Court on Thursday stayed its order of February 13 which directed eviction of people who had failed to establish themselves as forest dwellers under the Scheduled Tribes and other forest dwellers (Recognition of forest rights) Act 2006.

The Supreme Court stays its order to evict people who failed to establish themselves as forest dwellers.

The apex court asked the states to submit details of the rejection process stating the reasons within 4 months.

The bench, headed by Justice Arun Misra, asked the concerned authorities whether the state level monitoring committees monitored the rejection process.

The Central and the Gujaratgovernment had moved to Supreme Court on Wednesday appealing to put a stay on its February 13 order which would evict a million people from forest lands.

The chief secretaries of Andhra Pradesh, Assam, Bihar, Chattisgarh, Uttrakhand, Uttar Pradesh, West Bengal, Tripura, Telangana, Tamil Nadu, Odisha, Rajasthan, Madhya Pradesh, Jharkhand, Karnataka, Kerela and Maharashtra were asked to justify the non-eviction of such people on or before July 24.

It has asked the states to submit details of the rejection process stating the reasons why people's claim was rejected within 4 months.


Body:The bench headed by Justice Arun Misra has also directed authorities who passed the orders of rejection and also asked weather state level monitoring committees under the act monitored the process.

The Central and the Gujrat government had moved to Supreme Court yesterday appealing to put a stay on its 13th February order which would lead to a million people evicted from forest lands.


Conclusion:The Chief secretaries of Andhra Pradesh, Assam, Bihar, Chattisgarh, Uttrakhand, Uttar Pradesh, West Bengal, Tripura, Telangana, Tamil Nadu, Odisha, Rajasthan, Madhya Pradesh, Jharkhand, Karnataka, Kerela and Maharashtra were asked justification of non eviction of people whose claims were rejected on or before 24rth July.
