New Delhi: Association for Democratic Reforms has filed a petition in the Supreme Court seeking directions to constitute an independent selection committee to appoint members in the Election Commission. It argues that the executive's sole role of "pick and chose" defeats the purpose of its creation and makes it a part of the executive only.
"Democracy is a facet of the basic structure of the constitution and to ensure free and fair elections and to maintain healthy democracy in our country, the Election Commission should be insulated from political and executive interference," reads the plea.

The plea filed by veteran Advocate Prashant Bhushan contends that EC renders 17 quasi-judicial functions between various parties and in such case, it is not appropriate for the executive to be a part of the selection process of EC members as there will be biasness.

The organisation has sought implementation of 255th Law Commission Report, which recommends that Election Commissioner should be made by the President in consultation with the Committee consisting of PM, leader of opposition in Lok Sabha and Chief Justice of India.
