Patna: The Patna High Court will hear the petition against Congress leader Rahul Gandhi in the Modi surname remarks case. The petition has been filed against Rahul Gandhi by former Deputy CM of Bihar and BJP MP Sushil Kumar Modi in 2019. Earlier on April 24, a single bench of Justice Sandeep Kumar at the Patna High Court had provided an interim relief to Rahul Gandhi while hearing the matter.
The its hearing on the said date exempted the Congress leader from appearing in the Modi surname case. Earlier, a MP-MLA court of Patna had ordered Rahul Gandhi to appear physically in the court on Apr. 25 under any circumstances. Rahul had challenged the order of the MP-MLA Court before the Patna HC on Apr. 24.

BJP MP Sushil Kumar Modi had in 2019 filed a petition against Rahul Gandhi accusing him of allegedly making defamatory statement against Modi surname. In his petition, BJP MP Sushil Modi had sought “adequate punishment” to Rahul Gandhi for his remarks. The court has recorded the statements of five persons in this case, including Sushil Kumar Modi.
The same year, Rahul Gandhi had said during a Lok Sabha campaign rally in Kolar Karnataka said that why the surname of all the “thieves” was common in an apparent attack on PM Modi. Significantly, a court in Surat, Gujarat on 23 Mar. this year convicted Rahul Gandhi in a defamation case over the Modi surname remarks and sentenced him to two years in jail in the case.
The very next day after the hearing, Rahul was disqualified by the Lok Sabha speaker as MP and later asked to vacate his accommodation.
