Kolkata: West Bengal government on Tuesday denied that the death of BJP MLA Debandra Nath Roy was a political murder or any state machinery was used in it.
The state government has also filed an affidavit in the Supreme Court against the plea seeking transfer of death case of Roy to the Central Bureau of Investigation (CBI) alleging biasness and unfairness.
The state said that as per the top court, it is not for the accused to choose the investigating agency in any case.
"In the present case, the petition has been filed by a third party on the basis of the unverified statement, tweets, and media reports, with no evidence whatsoever. No statement on the affidavit of any person with any personal knowledge of the case has been provided. There is thus not only no right to demand a transfer, but there is no basis for the petitioner to allege that the CBI ought to intervene and investigate the case," read the affidavit.
Citing the Calcutta High Court order, the state has contended that the petitioner had initially moved to the High Court but it also did not find any biasness or any other reason to transfer the case thereby disposing of the plea.
A suicide note was found on BJP MLA Debendra Nath who was found hanging outside a tea shop in the North Bengal district, said the affidavit. The autopsy reports indicated it was a case of suicide after allegations surfaced against Roy of misappropriation of funds, read the affidavit by Bengal government.
