High court stays the demolition of MLA Vijay Mishra's house

MLA Vijay Mishra got a big relief as Allahabad High Court has prohibited the demolition of his house. The MLA had filed a petition in the court, challenging the demolition stating that the demolition process started 15 minutes after the court's order on November 5, without giving him a legitimate opportunity to defend.

Bhadohi: The Allahabad High Court has prohibited the demolition of the house of MLA Vijay Mishra.

The MLA had filed a petition in the court, challenging the demolition stating that the demolition process started 15 minutes after the court's order on November 5, without giving him a legitimate opportunity to defend.

The court has asked the state government and the Prayagraj Development Authority to file a counter affidavit within two weeks.

The petition will be heard on December 2. The order has been given by Justice Ashwini Kumar Mishra on the petition of Indrakali and others.

Advocate Lokesh Kumar Dwivedi said that the demolition was ordered at 5 pm on November 5, 2020, and demolition operation was commenced within 15 minutes. The petitioner was not even given the chance to defend.

According to the sources, the house is named after both the petitioners Indrakali and Ramlali. The Prayagraj Development Authority( PDA) has given notice to only one.

On February 3, 1980, the former owner had obtained permission to construct. The petitioners had said that they would remove such construction themselves if found contrary to the approved map.
