Former IG dwells on powers of CBI
Radhakant Saxena, former Inspector General of prisons (Rajasthan) spoke extensively on the powers of the Central Bureau of Investigation (CBI).
It is to be noted that the officials of the CBI will not be allowed in Rajasthan without the permission of the state government.
The decision of the Ashok Gehlot government was taken a day after the Union Ministry of Home Affairs summoned the state government in the phone tapping case.

Rathore slams Congress for deteriorating state of affairs
Rajendra Singh Rathore, BJP leader and deputy leader of opposition in the State Legislative Assembly, said that the internal matter of the Congress has reached to the top court of the country.
He also said, "It's unfortunate that legislators are still lodged in the hotel. The special session of the assembly should have been called to discuss the matter of drought and locusts in the state."
He further said that the internal struggle and special session of the Congress will remain as a stigma for its governance.

CM Gehlot writes to PM Narendra Modi
Addressing the media, CM Ashok Gehlot said that he has written a letter to the Prime Minister over the political development in the state.
"I wrote it so that he doesn't say that he didn't have info or his people gave him incomplete info. I wrote it so that if I meet him, he doesn't say that he didn't know about the situation," Gehlot said.
Talking about audio-tapes, he said that they can send the audio-tapes to FSL agency in the US for a voice test.
"They should step forward and undergo a voice test. Union Ministers/MLAs/MPs give speeches so everyone knows it is their voice. Despite identifying the voices, the first reaction always is 'it wasn't my voice'. They are also threatening people. Nothing is going to work." 'Satyamev Jayate,' He added.

No stay in HC verdict in Speakers vs Rebel plea, next hearing on Monday
Supreme Court will take up the hearing of the petition on Monday.
"Speaker cant disqualify MLAs till we decide. There will be no stay in HC verdict in Speakers vs Rebel plea," the court said, adding that HC judgement is subject to HC verdict.
Supreme Court said that Rajasthan High Court can pass orders on Congress MLAs plea against disqualification notice from Rajasthan Speaker.
A Bench of Justice Arun Mishra refused the request of Rajasthan Speaker CP Joshi to stay the Rajasthan High Court proceedings on Sachin Pilot and MLAs petition against disqualification notice.

Court seeks response from Pilot's counsel Harish Salve
The court sought response from Harish Salve and Mukul Rohatgi, appearing for Sachin Pilot & 18 MLAs.
Salve said that the speaker had deferred hearing proceedings twice earlier. He said that issues of jurisdiction and maintainability have been argued before the HC. Having appeared and argued there, why should he now ask HC not to decide?

Supreme Court rejected Kabil Sibal's request to transfer the petition in HC to the apex court. SC sought a response from Pilot's counsel Harish Salve.
SC said that these are serious issues and needs a detailed hearing.

Asked about whether is permissible outside Assembly, Speaker's counsel Sibal said, "Party can issue whip to members to attend CLP. A whip is not defined anywhere. HC's interference has violated under the Tenth Schedule of Indian Constitution.
Senior advocate added, "Tenth Schedule says that a lawmaker can be disqualified from the House "if he has voluntarily given up his membership of such political party” or if he votes or abstains from voting in such House contrary to any direction issued by the political party to which he belongs or by any person or authority authorised by it in this behalf without obtaining prior permission of such political party.” But the law can be extended to behaviour/conduct outside the House too.
Reading out Speaker's notice to rebel MLAs, he said that MLA's can't file plea against Speaker's notice. Dissident MLAs are involved in anti-party activities.

Court cannot direct the speaker, says Kabil Sibal
Senior advocate Kapil Sibal, who is appearing for Rajasthan Speaker CP Joshi, said that the court can’t direct the Speaker to extend the time to file their replies to the anti-defection notices. It’s not in the jurisdiction of the court.
"When Rajasthan High Court extended time to reply on notices and said no directions will be passed, that was a protective order," he added.
Sibal added, "Rajasthan HC was wrong in issuing a direction to the Speaker. This is against settled law on this point.
Challenging the Court intervention, the senior Congress leader said that the Court cannot intervene if MLAs are not disqualified.

Pilot camp MLA wants Centre to be party in petition against Speaker
Jaipur: Congress MLA Prithviraj Meena filed an application before Rajasthan High Court seeking Centre to be impleaded in the ongoing case filed by rebel Sachin Pilot and 18 other MLAs case challenging Para 2 (1) (a) of the Schedule X of the Constitution.
In his petition filed on Wednesday, he said, "It is humbly prayed that Union of India through The Secretary, Ministry of Law and Justice (Department of Legal Affairs), be made a Party Respondent to the present writ petition in the interest of justice and law."
The Speaker CP Joshi served disqualification notices to 19 rebel MLAs including Pilot for their alleged 'anti-party activities' soon after they skipped two meetings of Congress legislative party meetings.
He was first asked to defer action by three days last week when the High Court began the hearing of the case.

Team Sachin Pilot was given a second three-day breather on Tuesday by the High Court after it finished hearing its arguments and reserved its judgement to be announced on July 24.
The rebels had argued that no whip can be in place when the assembly is not running in session and said they have no plans to quit the Congress but they want a change in its Rajasthan leadership.

Rajasthan Political Crisis: CM Gehlot writes letter to PM Modi over political situation in state
New Delhi: The Supreme Court will hear a plea of Rajasthan Assembly Speaker C P Joshi today against the high court order restraining him till July 24 from conducting disqualification proceedings against 19 dissident Congress MLAs, including sacked deputy chief minister Sachin Pilot.
As per the list of business uploaded on the Supreme Court website for July 23, a bench of Justices Arun Mishra, B R Gavai and Krishna Murari would hear the plea.
Earlier, in the day Speaker C P Joshi moved the top court against the Rajasthan High Court order saying the 'judiciary was never expected' to intervene in such matters resulting in 'constitutional impasse'.

Seeking an interim stay on the high court's July 21 order, the plea has said that it was the duty of the top court to ensure that all constitutional authorities exercise their jurisdiction within the boundaries and respect their respective 'Lakshman Rekha' as envisaged by the Constitution itself.
