Hearing adjourned, Pilot camp to file amended petition

Rajasthan High Court adjourns hearing on Sachin Pilot's plea challenging the notice issued to him and his supporting MLAs for not attending Congress Legislative Party meet.

The High Court granted time to Sachin Pilot and 18 other dissident Congress MLAs to file an amended petition challenging the disqualification notices issued to them by the Rajasthan Speaker. The petition against the move to disqualify the rebel MLAs from the state assembly was taken up for hearing at 3 pm.

But senior Advocate Harish Salve, appearing for the petitioners, sought time to amend it. Salve argued that the MLAs wanted to challenge the constitutional validity of the notices and needed some time to file it afresh. The matter would now be heard by the division bench of the high court.

Sachin Pilot and Congress MLAs supporting him had moved Rajasthan HC against Legislative Assembly Speaker CP Joshi's disqualification notice to rebel MLAs.

Speaker Joshi had on Tuesday issued notices to rebel MLAs after the Congress party sought their disqualification from the Rajasthan assembly. Meanwhile, Sachin Pilot and his loyalists were asked to respond to the notices by Friday.

Pilot camp moves HC, challenges notice seeking MLAs' disqualification from assembly

The Rajasthan High Court will hear on Thursday afternoon a petition filed on behalf of the Sachin Pilot camp, challenging a move to disqualify dissident MLAs from the state assembly.

The plea against the disqualification notices sent from the Speaker's office to Pilot and 18 other Congress MLAs will be heard by Justice Satish Chandra Sharma.

The 19 MLAs were sent notices on Tuesday by the Speaker after the Congress complained that they had defied a party whip to attend two Congress Legislature Party meetings.

The Pilot camp, however, argues that a party whip applies only when the assembly is in session.
In its complaint to the Speaker, the Congress sought action against Pilot and the other dissidents under paragraph 2 (1) (a) of the Tenth Schedule of the Constitution.

  • False rumours spread to malign

    Pilot : “ I am not joining BJP “

I guess then legislators at a hotel in Manesar is merely a vacation in Haryana’s comfort zone under BJP’s watchful eye

What about “ ghar wapsi “?

    — Kapil Sibal (@KapilSibal) July 16, 2020 " class="align-text-top noRightClick twitterSection" data=" ">

Jaipur (Rajasthan): Veteran party leader Kapil Sibal on Thursday hit out at him saying it seems that the MLAs in Haryana's Manesar are on vacation and asked what about 'ghar wapasi' (coming back).

"False rumours spread to malign. Pilot: 'I am not joining BJP'. I guess then legislators at a hotel in Manesar is merely a vacation in Haryana's comfort zone under BJP's watchful eye. What about 'ghar wapsi'?" Sibal said in a tweet mocking at Pilot.

Sibal's remarks came a day after Pilot told media that he had no plans to join the Bharatiya Janata Party and alleged that some people were spreading false rumours to malign his image in the eyes of the senior leadership.

On Tuesday, Congress sacked Pilot as both Rajasthan PCC chief and Deputy Chief Minister for leading the rebellion against the leadership of Ashok Gehlot.

Sibal was the first person in Congress to raise the red flag amid the crisis over the survival of its government in Rajasthan.

"Worried for our party. Will we wake up only after the horses have bolted from our stables?" the former Union Minister tweeted.

The Rajasthan Congress is in turmoil over the past few days. While Chief Minister Ashok Gehlot has blamed the BJP for attempting to destabilise the state government by poaching MLAs, Deputy Chief Minister Sachin Pilot has been camping in Delhi.

A controversy broke out in Rajasthan after Special Operation Group (SOG) sent a notice to Pilot to record his statement in the case registered by SOG in the alleged poaching of Congress MLAs in the State.

The party faced its second political crisis within months of a revolt led by Jyotiraditya Scindia in Madhya Pradesh, which ousted the Kamal Nath government in that state.
