Returning Officer accepts candidature of BJP's Scindia, Sumer Singh for RS polls

Returning Officer on Tuesday approved the candidature of BJP leaders Jyotiraditya Scindia and Sumer Singh Solanki for the March 26 Rajya Sabha polls from Madhya Pradesh.

While Scindia has joined BJP last week after quitting Congress, Solanki has resigned from the post of assistant professor.Scindia was part of the Congress Party for almost two decades.

There are three vacant Rajya Sabha seats in Madhya Pradesh. Polls for 55 Rajya Sabha seats in different states are scheduled to be held on March 26.

Madhya Pradesh Assembly Speaker NP Prajapati has written a letter to Lalji Tandon saying," I received resignations of 16 MLAs through other people. MLAs were directed to be present in person according to rules of House but none of them complied. Resignations are under consideration"

The letter further states, "Family members of some of the 16 MLAs have expressed concerns over the safety of the MLAs. I am very worried about these MLAs and request you to take concrete steps to allay our fears".

BJP leaders meet Guv over new appointments made by Nath govt

Madhya Pradesh BJP chief V.D. Sharma, former Chief Minister Shivraj Singh Chouhan and the leader of the Opposition Gopal Bhargava met Governor Lalji Tandon on Tuesday evening and asked him to prevent the large-scale appointments being made by the Kamal Nath government. They contended that the minority government can't make constitutional appointments.

They said the government had made several appointments without taking the Governor into confidence. The government announced the appointment of Shobha Ojha as the chairman of Women's Commission, J.P. Chanopia as chairman of Backward Classes Commission and even the new Chief Secretary Gopal Reddy. The retiring Chief secretary S R Mohanti has been appointed the Director-General of the RCV Noronha administrative academy.

Most of the appointments have been made after the ruling party lost the majority in the Assembly, said BJP leaders.

The Governor said he was not aware of these appointments and transfers and will look into the appointments.

Chouhan said the BJP will resist all the appointments till the government clears the floor test.

MP CM trying to save govt by allurement and pressure: Chouhan

Senior BJP leader Shivraj Singh Chouhan, who has moved the supreme court seeking immediate floor test in the Madhya Pradesh Assembly, on Tuesday accused the Kamal Nath government of employing "pressure and allurement" tactics to save it from falling.

Chouhan's statement came hours after the apex court asked the state government to give by Wednesday its response to his plea seeking a direction for an immediate floor test.

Chouhan also reiterated that the saffron party has the requisite numbers to prove its majority on the floor of the House.

"Everything will be clear...The Kamal Nath government should face the floor test at the earliest. They are buying time so that the attempts could be made to save the government through pressure and allurement," Chouhan told reporters here when asked about the apex court order.

He said the BJP paraded its MLAs in front of Governor Lalji Tandon on Monday.

"The Kamal Nath government has lost majority (in view of resignations by 22 MLAs of Congress last week). The BJP has the required majority among the available numbers in the House and it will be proved in the Assembly," the former chief minister said.

Speaking to media, BJP leader Shivraj Singh Chouhan said: "Bengaluru MLA has said clearly that they are against the Congress government in the state. They are willingly staying there in Bengaluru. Kamal Nath ji should as soon as possible should get the floor test done".

Madhya Pradesh Assembly's principal secretary AP Singh said: "We have not received any information as such on FloorTest, if such a proposal comes a decision will be taken by the Speaker and put forth before the House."

On being asked if he has received a Confidence or No-Confidence Motion Singh said: "We have not received any official information yet. It has come to our knowledge that some document has been given to the Speaker by the Leader of the Opposition."

"The Supreme Court will be given information from both sides. The state government will take action as per SC's directions. Action will be taken here too (at State Assembly) if there is a direction for us," he added.

MP CM forwards governor's letter on floor test to Speaker

Madhya Pradesh Chief Minister Kamal Nath on Tuesday forwarded fresh directives given to him by state Governor Lalji Tandon on holding a floor test to speaker of the Assembly for further action.

In his letter to the governor on Tuesday, the CM said,"Keeping into account all facts, I have forwarded your direction to me to the Assembly Speaker for an appropriate action".

On Monday, Tandon wrote to Nath to hold a floor test on Tuesday, stating that the failure to do so will mean the CM does not enjoy majority in the House.

SC seeks response of MP govt on Chouhan's plea seeking floor test

The Supreme Court has asked the Kamal Nath government in Madhya Pradesh to give by Wednesday its response to former chief minister Shivraj Singh Chouhan's plea seeking a direction for an immediate floor test in the assembly. 

A bench headed by Justice D Y Chandrachud on Tuesday said it will issue notice to the state government and others, including the secretary of the legislative assembly, for tomorrow at 10.30 am.

Chouhan and nine other BJP lawmakers, including leader of opposition in the state assembly, moved the Supreme Court on Monday just after Speaker N P Prajapati cited coronavirus concerns and adjourned the house till March 26 without taking the floor test, apparently defying Governor Lalji Tandon's directions. 

Appearing for the senior BJP leader and three-time chief minister, senior advocate Mukul Rohatgi said "the rationale in this case is that a floor test is required and usually the other side appears in such cases".

Taking note of the submission, the bench said, "We will have to issue a sought notice and keep it for tomorrow morning."

The bench then took note of the submission of senior advocate Maninder Singh appearing for 16 rebel Congress MLAs that they be also allowed to become parties to Chouhan's petition.

Singh said 22 Congress MLAs have resigned from the assembly and the resignations of six lawmakers have already been accepted.

He said the remaining 16 MLAs also want their resignations to be accepted.

The bench granted Chouhan the liberty to serve the copy of the petition to the state government, speaker and others through e-mail besides traditional modes of service notice.

On Saturday night, the Madhya Pradesh governor wrote to Nath asking him to seek a trust vote in the assembly soon after the governor's address on Monday, saying his government was in a minority.

 After the speaker accepted the resignation of six Congress MLAs on Saturday, the party now has 108 legislators.

These include 16 rebel legislators who have also put in their papers but their resignations are yet to be accepted.

The BJP has 107 seats in the House, which now has an effective strength of 222, with the majority mark being 112.

Floor test likely to take place in MP Assembly today to decide fate of Kamal Nath govt

Amid the power crisis in Madhya Pradesh ensuing the exit of stalwart Jyotiraditya Scindia from the Congress party, the floor test to decide the fate of the Chief Minister Kamal Nath-led Congress government is likely to be held on Tuesday as per the directions of Governor Lalji Tandon.

Earlier yesterday, Tandon had written a letter to Chief Minister Kamal Nath directing him to conduct the floor test on March 17 after the state Assembly was adjourned till March 26 by Speaker NP Prajapati, in view of coronavirus.

The Governor's directions came after a BJP MLA delegation led by former CM Shivraj Singh Chouhan met Governor following the adjournment of Assembly.

New Delhi: The Supreme Court on Tuesday will hear the petition filed by Bharatiya Janata Party (BJP) seeking an immediate floor test in Madhya Pradesh Assembly.

A two-judge bench, headed by Justice Dr. DY Chandrachud and Justice Hemant Gupta will hear the plea filed by former chief minister and BJP leader Shivraj Singh Chouhan, who sought urgent direction from the apex court to the Speaker to conduct a floor test as the latter had postponed it to March 26.

The BJP on Monday approached the Supreme Court seeking a floor test in the Madhya Pradesh assembly amid the ongoing political crisis in the state, which was sparked off by the exit of Congress leader Jyotiraditya Scindia.

The petitioners said that they are approaching the apex court as the respondents, Speaker and Madhya Pradesh Chief Minister, have violated the constitutional principles and have deliberately and willfully defied the directions issued by the Governor on March 14, requiring the Chief Minister to prove his majority on the floor of Madhya Pradesh legislative assembly.

"It is submitted by the petitioners that the leaders of the main opposition party namely the BJP also on March 14 had addressed a letter to the Madhya Pradesh Governor that the government was reduced into minority and attempts of horse-trading were being made," the petition said.

The petition said that in such a situation, the Governor should exercise his constitutional powers and direct the Chief Minister to prove his majority on the floor of the house.

"Since the government appears to have lost the majority in the House and the Chief Minister had himself expressed willingness to conduct the floor test, the Governor, in the exercise of his constitutional powers directed the Chief Minister to conduct a floor test in the house and prove his majority on March 16, 2020, when the budget session of the assembly begins," the petition said.

However, despite the clear directions issued by the Governor, the item for seeking the confidence vote has not been included in the business to be transacted on the floor of the House on Monday.

The direction of the Governor is, thus, intentionally and wilfully been defied, the petition stated.

The development comes as the Madhya Pradesh Assembly, which met on Monday morning for the Budget session was adjourned immediately after the Governor's address till March 26, in view of the coronavirus outbreak.

Meanwhile, Madhya Pradesh Governor Lalji Tandon has written a letter to Chief Minister Kamal Nath directing him to conduct the floor test on March 17.
