Land de-notification case: SC to hear Yediyurappa's plea challenging HC order

A three-judge bench of the Supreme Court will today hear the plea filed by Karnataka Chief Minister BS Yediyurappa challenging the earlier High Court order restoring a criminal complaint against him related to alleged criminal conspiracy and forgery of documents in a land de-notification case.

New Delhi/Bengaluru: The Supreme Court is scheduled to hear on Wednesday the plea filed by Karnataka Chief Minister BS Yediyurappa against the High Court order to restore a complaint alleging forgery over the withdrawal of approval for a parcel of land.

A three-member bench of the apex court constituting Chief Justice SA Bobde, and Justices AS Bopanna and V Ramasubramaniam will hear the petition today.

Earlier on January 6, the Karnataka High Court had restored a complaint alleging forgery over the withdrawal of approval for a parcel of land and refused to quash an FIR filed against Yediyurappa in an 'illegal' land de-notification case of 2015.

The case under Indian Penal Code and Prevention of Corruption Act related to alleged criminal conspiracy and forgery of documents purported to have been issued by the petitioner Alam Pasha in 2012 when Yediyurappa was the chief minister in his first term.

Besides Yediyurappa (the then chief minister), former minister for industries Murugesh Nirani, former principal secretary V P Baligar and former managing director of Karnataka Udyog Mitra Shivaswamy K are the other accused.

They have been accused by the petitioner of committing forgery of documents purported to have been issued by her seeking to withdraw the approval granted for allotment of 26 acres of land at Devanahalli Industrial Area in Bengaluru Rural District.

The petitioner had also lodged a private complaint about the matter in Lokayukta.

Yediyurappa had filed a petition at the High Court in 2019 asking for the cancellation of the FIR filed by the Lokayukta police and the special court proceedings. On January 5, the High Court had dismissed the application and ordered for the hearing.
