HC's notice to govt on 5-month-old's plea for traffic ban in Cubbon Park

The Karnataka High Court issued notice to the State Government after considering a public interest litigation filed by a five-month-old infant, seeking a ban on traffic within and through Cubbon Park in Bengaluru.

Bengaluru (Karnataka): The Karnataka High Court Has issued a Notice to the State Government and other Administration, After the PIL Filed by a Five-Month old Infant Seeking to Ban the Vehicle Trafficking within and the Through the Cubbon Park in the City.

The plea, which states that the petitioner is a five-month-old Bengaluru citizen, said that the decision of the Karnataka government to allow vehicle trafficking inside the park is an environmentally irresponsible action that is directly affecting the health of Human Beings, and quality of life.

Hearing the plea, A bench of Justice BV Nagarathna and Justice Nataraj Rangaswamy directed the Karnataka state government, the traffic police, the Karnataka State Disaster Management Authority, and the Directorate of Urban Land Transport to file their statements of objection. The court also turned down the petitioner’s counsel prayer for interim relief, stating that granting the plea would surmount to a final order.

Petitioner Said as I have been Wandering in Cubbon Park with my parents for several days. In the Current Days, carbon monoxide has increased due to the traffic of vehicles inside Cubbon Park. This has a negative impact on Our health. Also, its constitutional right to live healthy in a pollution-free environment is being violated. Thus, it is requested that the government be given proper directions to ban the traffic inside the park.

Petitioner’s counsel stated that during the pandemic, the park was closed, and this helped reduce the levels of carbon monoxide inside the park. However, later, the park was reopened after COVID-19 restrictions were eased in the state.

Previously, Cubbon Park Walkers' Association had filed petitions seeking a ban on vehicle Trafficking. The Divisional Bench, headed by the Chief Justice directed the government to take appropriate action on the request of the petitioners on October 22 and settled the petition.
