Stripping lawyer of his designation is a virtual death penalty: Supreme Court

The Supreme Court has observed that stripping a lawyer off his designation is a virtual death penalty. The Supreme Court deferred the hearing on Gujarat High Court Advocate Yatin Oza's plea against the stripping of his senior designation.

Ahmedabad: Deferring the hearing on Gujarat High Court Advocate Yatin Oza's plea against the stripping of his senior designation, the Supreme court observed today that taking away the senior designation from an advocate is virtually a death penalty.

The bench led by Justice Sanjay Kishan Kaul was hearing a petition challenging the Gujrat High Court order which initiated a suo moto contempt against him for remarks against the registry and had stripped him of his senior designation. During one of his press briefings, Oza had accused registry of corruption.

After the contempt proceedings, Oza had apologised to the High Court and even in the Supreme court ensuring that he would avoid such incidents in future. But not accepting it, the full court of Gujrat HC decided to take away his designation. SC also had expressed concern over the matter.

Today the court said that they will examine the proportionality of the punishment later and adjourned the matter for hearing on 8th December.
