New Delhi : The Supreme Court ordered a re-examination of the rape case filed against BJP national general secretary Kailash Vijayvargiya by the judicial magistrate. The apex court today quashed the orders of a court probing the rape charges made by a woman against the BJP leader. In this case, the police took the complaint of the woman but are yet to register an FIR.
In a petition in the past, the complainant woman sought the registration of a case against Vijayvargiya and other BJP leaders for raping her and also for threatening to kill her son. However, at that time, the court rejected the accusation but ordered a probe. Vijayvargiya approached the High Court but did not get relief and later knocked on the doors of the Supreme Court.
The apex court cancelled the entire action taken earlier and sent the whole matter again to the Magistrate Court. In December 2019, the complainant filed a petition in the court demanding the registration of an FIR. Now, the BJP leader got a major relief from the SC as the magistrate is ordered to re-examine the whole case.
During a hearing in the past, the Supreme Court granted interim relief to Kailash Vijayvargiya from police arrest in the case. The woman, who is a prosecutor, alleged that Vijayvargiya and other BJP leaders called her to a flat and sexually assaulted her. She also complained that the BJP leaders assaulted her on many occasions prior to this. With the latest orders of the Supreme Court, the FIR also cannot be booked against the BJP leaders.
