Nirbhaya Case: PIL in SC seeks live telecast of rapists' execution

A Public Interest Litigation has been filed in the Supreme Court to carry out live telecast of the hanging of the accused. The plea also seeks for a direction to frame guidelines for completion of both police probe and trial in fast track court within six months in rape and Protection of Children from Sexual Offences (POCSO) cases.

New Delhi: A Public Interest Litigation (PIL) was filed in the Supreme Court on Friday seeking death-row convicts in the Nirbhaya rape and murder case to hanged within a month and their executions be live telecasted.

The petition sought that review and curative petition of the convicts be disposed of within a month. The Supreme Court is slated to hear review plea of one of the convicts, Akshay Kumar Singh, on December 17.

"Dispose of all the Nirbhaya accused review, curative and mercy petitions within one month and to execute the death warrants of all accused by hanging within one month," the petition stated.

It also requested to carry out live telecast of the hanging of the accused. "Allow the Nirbhaya family to watch the execution (like in the USA) of the all accused of Nirbhaya case so that it may bring closure to the Nirbhaya family."

The petitioner also demanded that the cost of the hanging rope must be retrieved "so that the accused family may understand that it was their responsibility too to impart values in their rapist son."

The plea sought for a direction to frame guidelines for completion of both police probe and trial in fast track court within six months in rape and Protection of Children from Sexual Offences (POCSO) cases.

It also sought appeals in the High Court and Supreme Court to be completed within four months and three months, respectively.

"Review and Curative Petition in further three months in any rape and POCSO case," it read.

It sought setting up of fast track courts in every district and sessions court and one dedicated bench in every High Courts and Supreme Court for disposing of rape and POCSO cases.

The case pertains to gang rape and murder of a 23-year-old paramedic student on December 16, 2012. The six accused were apprehended by the police.

Out of six persons, one was a minor and appeared before a juvenile justice court, while another accused committed suicide in Tihar jail.

The four convicts had then approached the Delhi High Court but it upheld the lower court verdict. Later, the Supreme Court, too, upheld the death penalty in May 2017. The rest of the convicts are facing the gallows.

One of the convicts, Vinay, moved a mercy petition last month but has now sought to withdraw it.

Intro:A lawyer named Sanjiv Kumar has moved to the Supreme Court seeking directions from the Supreme court to diapose off the review, curative and mercy petitions of the Nirbhaya rape convicts within one month and execute their death warrants as well within a month. The petition also seeks live telecast of hanging of the accused or allow the Nirbhaya family to watch the execution. The petition reads,"it may bring closure to Nirbhaya family."


Body:The petition not only just mentions about the Nirbhaya case but also Jisha rape and murder case of 2016 which happened in Kerela.It seeks directions to dispose off the accused HC appeal, SC appeal, review, curative and mercy petitions and execute the death sentence by hanging in a time bound manner.

The petition reads,"We Indians have defined the new meaning of Temporary and Fast track. Temporary as in Article 370 which lasted 70+ years and fast as in Nirbhaya case which is 7+ years already."

Citing the grounds of his petition, Kumar states that, death penality is the "only fitting retribution of rape and murder" and "rape is nothing short of terrorism and every terrorist must die." He says that any lesser punishment would undermine the value society places on protecting lives.

Citing reasons for dealth peanality in both Nirbhaya's and Jisha's case, the petition reads,"killers should not lie in some prison with three meals a day, clean sheets, cable TV, family visits and endless appeals, and mercy petitions. For justice to prevail some killers just need to die." It adds that taking the murderer's life restores the balance in the society and convinces that it is an "intolerable crime".



Conclusion:On 16th December, 2012, Nirbhaya was brutally gang raped by 6 men and thrown out of bus along with her friend. On 29th December, she succumbed to the injuries.The matter is still pending the court and hearing is scheduled in the Supreme court on 17th december. Nirbhaya's mother also moved to the Supreme Court today seeking to be heard on 17th december along with the accused.

Jisha, 9 year old law student at the Government law college, Ernakulam was found murdered on 28th April,2016 in Perumbavoor, Ernakulam. The preliminary investigation revealed that she was stabbed 30 times and murdered when she resisted rape attempt.The trial court had given a death penality to the accused in this case as well.
