Centre moves SC seeking to be a party on Rhea Chakraborty's petition

The centre has moved to the Supreme Court seeking to be a part of the case wherein Rhea Chakraborty has filed a petition seeking transfer of cases from Mumbai to Bihar.

In the last hearing, the Justice Hrishikesh Roy led bench had asked the Bihar and Maharashtra government to file their replies on the matter and had adjourned the hearing for next week.

Can't rush into hearing pleas on Sushant case probe: HC

The Bombay High Court on Friday said it cannot rush into hearing pleas seeking transfer of probe in the Sushant Singh Rajput death case to the CBI as the Supreme Court is seized of the matter as the Centre questioned the way the Maharashtra government was handling the case.

A division bench of Chief Justice Dipankar Datta and Justice A S Gadkari was hearing two petitions raising concerns over the manner in which the Mumbai police were investigating the case and the media reporting on it.

The pleas - one filed by Nagpur resident Sameet Thakkar, and another by Priyanka Tiberwal, a lawyer practising in the Calcutta High Court sought the Bombay HC's direction to the CBI to probe the case.

The bench also issued notices to two organisations dealing with the media.

Actor Rhea Chakraborty, accused of abetting the suicide of filmstar Sushant Singh Rajput, appeared before the Enforcement Directorate (ED) here on Friday in connection with the money laundering case lodged by it.

The ED had summoned Rhea Chakraborty for questioning on Friday (August 7), but she had requested the agency to postpone the recording of her statement pending the hearing of her plea filed in the Supreme Court seeking transfer of the case lodged by the Bihar police to Mumbai.

The Enforcement Directorate (ED) has summoned Shruti Modi, former business manager of Sushant Singh Rajput, asking her to appear before the agency today.  

ED also asks Sushant's friend Siddharth Pithani to appear before the agency August 8.

The agency had on July 31 registered an Enforcement Case Information Report (ECIR) in the case after a First Information Report (FIR) was filed by KK Singh, the late actor's father against actor Chakraborty in Bihar on July 28.

Transfer petition is misconceived and not maintainable: Bihar govt

The Bihar Government has filed an affidavit in the Supreme Court stating that the transfer petition filed by Rhea Chakraborty is "misconceived and not maintainable".

"The submission of the petitioner (Rhea Chakraborty) that the entire cause of action arose in Mumbai and the State of Bihar has no jurisdiction to register FIR is liable to be rejected in view of the provisions under section 179 of CrPC," the affidavit stated.

Bihar Government has also said mentions that the state government has the jurisdiction to investigate the matter.

Unless Maharashtra Government consents to CBI investigation within the Sushant Singh Rajput’s dying case, it might be unlawful, affecting the federal construction of the nation, mentioned actor Rhea Chakraborty’s lawyer.  

The Central Bureau of Investigation (CBI) has registered and continued the illegality which was perpetrated by the hands of Bihar Police in reference to the case, he added.

“The Bihar Government transferred a case with which it had no jurisdiction to investigate, to CBI instead of the Mumbai Police which is the legal position. The Supreme Court is seized of the issue pursuant to the transfer petition filed by Rhea Chakraborty,” mentioned Satish Maneshinde Chakraborty’s lawyer.

The Supreme Court has directed all events to file their replies and Mumbai Police is directed to position the report of investigations, he added.

“Pending the said proceedings the CBI has registered and continued the illegality which was perpetrated at the hands of Bihar Police. CBI being a premier investigative agency in the country should desist from taking any further steps pending the SC proceedings. Apart from the same unless the Maharashtra Government consents to CBI investigating the case … it would be totally illegal and beyond any known legal principles, affecting the Federal Structure of the Nation,” mentioned Maneshinde.

Bihar IPS officer Vinay Tiwari released from quarantine, to leave for Patna today 

Bihar IPS officer Vinay Tiwari, who was quarantined in Mumbai, will leave for Patna on August 07. 

Mumbai Police had quarantined Bihar IPS officer Vinay Tiwari. Tiwari had come to Mumbai to investigate in Sushant Singh’s death case after late actor’s father filed an FIR against Rhea Chakraborty. 

Vinay Tiwari said, “BMC has informed me, through a text message that I can go out of quarantine. I'll be leaving for Patna now”.

Four other Bihar police officers had returned to Patna on August 06.

ED interrogated Rhea Chakraborty's associate Samuel Miranda for 9 hours

The Enforcement Directorate (ED) on Thursday questioned a staffer of actor Sushant Singh Rajput for the second consecutive day in a money laundering case stemming from a complaint filed by the actor's father with the Bihar Police in connection with his death, officials said.

They said Samuel Miranda was questioned at the central probe agency's office in Mumbai and his statement recorded under the Prevention of Money Laundering Act (PMLA).

He was questioned by the ED on Wednesday too.

The ED is understood to be questioning him about the activities at the late actor's house in Bandra area of Mumbai.

Patna: Bihar DGP Gupteshwar Pandey on Thursday said a fresh letter has been sent to Mumbai municipal authorities seeking the release of an IPS officer, who had gone to the city to probe actor Sushant Singh Rajput's death and was quarantined, and warned that refusal to pay heed could evoke strong action from the Supreme Court.

Pandey rued that Vinay Tiwari, posted here as the SP (city), was treated like a prisoner and a quarantine mark was stamped on his hand while placing him under house arrest.

He said the failure of the BMC officials to act timely could draw the ire of the apex court, where a petition relating to the actors death by suicide was to come up for hearing in a few days.

Earlier in the day, he had warned of legal action if the IPS officer from Bihar was not released from "forcible quarantine".

Speaking two days after the high-profile case was handed over to the CBI, the DGP also expressed the view that "first and foremost" actress Rhea Chakraborty should be arrested and grilled and that he was doubtful that she would appear on her own before the Enforcement Directorate which has slapped her with a money laundering case.

A letter was today sent by the IG, Patna Zone, to the chief of the BMC which needs to understand that the country is governed by the Constitution framed by (BR) Ambedkar and not at the whims of the municipal body, he told a TV news channel.

The DGP, who had earlier hinted that the Bihar police might approach the court if Tiwari was not released by the end of the day, said, "Such a move is not required right now. The IGP had apprised the BMC officials about the adverse remarks made by the Supreme Court against our officer being held captive in Mumbai. He has again written a letter today reiterating it.

It is tantamount to house arrest. Our officer visits the city for official work and, in the thick of the night, an ambush (chhapamari) is laid and a quarantine stamp is put on her hand with the decree that he cannot go out and speak to anybody, Pandey fumed.

He lamented that things came to such a pass despite him having personally requested his Maharashtra counterpart that Tiwari be released.

All these people will face the music (napenge ye sab log), Pandey said, adding indignantly Thousands of people who land at the Mumbai airport daily are not quarantined. Let them give it to us in writing that they do not care for what the Supreme Court has to say. They will face the consequences".

Asked about the inputs provided by four junior rank officials, who returned earlier in the day after spending a week in Mumbai for investigation, the DGP replied, I have not spoken to them, but the SSP and the IGP have. Moreover, during investigation details should not be shared with media.

The Bihar DGP also said he was hopeful that the CBI, which was a professional agency and has now taken over the probe, following a recommendation by the state government, will uncover the truth behind the death of the 34-year-old actor.

Pandey said Chakraborty should "first and foremost be arrested and thoroughly interrogated. There have been too many inconsistencies in whatever she has been saying. The needle of suspicion naturally points in her direction.

Chakraborty, a budding actress, was said to be in a relationship with Rajput. She was accused, along with her family members, of abetting the actors suicide by the latter's father KK Singh who lodged an FIR at a police station in Patna more than a month after his son was found dead at his Bandra residence.

Chakraborty has moved the Supreme Court challenging the Bihar governments jurisdiction in the matter and seeking transfer of the investigation following the FIR from Patna to Mumbai.

Bihar IPS officer Vinay Tiwari, who was quarantined in Mumbai, will leave for Patna on August 07. 

Mumbai Police had quarantined Bihar IPS officer Vinay Tiwari. Tiwari had come to Mumbai to investigate in Sushant Singh’s death case after late actor’s father filed an FIR against Rhea Chakraborty.
