Gupkar alliance moves SC seeking early hearing of pleas against Article 370 move

The PAGD has moved a writ petition in the Supreme Court of India, seeking an early hearing of the plea regarding Article 370.

New Delhi: The People's Alliance of Gupkar declaration (PAGD) has moved a writ petition in the Supreme Court of India, seeking an early hearing of the plea regarding Article 370.

The petition was moved by CPI(M) leader Mohammad Yousuf Tarigami. In his submission, Targami claimed that "despite the fact that the matter is pending before the Supreme Court on August 5, 2019, regarding the constitutional validity of the Jammu and Kashmir (Reorganization) Act, 2019, the Central Government has taken some irreversible decisions."

He said that the central government has constituted a delimitation commission to mark the boundaries of all constituencies before the Assembly elections.

The petition further read, "The Jammu and Kashmir Development Act has been amended to allow those who are not permanent residents to buy land in Jammu and Kashmir if it is not agricultural land. Institutions such as the State Women's Commission, the Jammu and Kashmir State Accountability Commission, the Jammu and Kashmir State Consumer Protection Commission and the Jammu and Kashmir State Human Rights Commission were shut down."

The petitioner said, "In view of the aforesaid steps taken by the Central Government, it has been suggested that the challenge of constitutional legitimacy should be heard on an urgent basis otherwise the petition itself will be inconclusive in view of irreparable action."

He further said in his petition that if the matter was not heard immediately, there would be severe injustice to the petitioner.

Tarigami said that in view of the matter, the petitioner was seeking an early hearing of the writ petition.

Tarigami submitted in the petition that the court may be pleased to list his writ petition (Civil) no. 1210 of 2019 on an early date, in the interest of justice and pass such other order or further orders as the Court may deem fit and proper in the circumstances of the case.

A meeting of PAGD held on Tuesday reiterated the demand for the restoration of Jammu & Kashmir's statehood and special status.

Article 370 which accorded special status to Jammu & Kashmir was abrogated on August 5, 2019.
