Saloni Kumari case is not a bar to hear OBC quota issue in Madras HC: SC

Supreme Court has directed the Madras High Court to hear a plea seeking directions to ensure reservation for OBC in state-surrendered All India Quota in Post Graduation medical admissions by saying that the pending matter of Saloni Kumari case must not become a hurdle in the Madras High Court hearing into the matter.

New Delhi: The Supreme Court on Monday has asked the Madras High Court to hear a petition seeking directions to ensure reservation for Other Backward Classes (OBC) in state-surrendered All India Quota in Post Graduation (PG) medical seats.

The judges said that the pendency of Saloni Kumari case before the Supreme Court (SC) is not a bar to hear the matter by Madras High Court (MHC).

The SC further asked the MHC to hear the petition by DMK and others related to the 50 per cent reservation in the state captured All India quota in PG Medical admissions. The MHC can hear and dispose of the matter according to the SC.

DMK Rajya Sabha member and Senior Advocate P Wilson appeared in the matter argued that the Central Government in 2016 itself filed a counter affidavit in the Saloni Kumari case admitting that it is bound to give OBC reservations in state surrendered seats to the All India quota.

"However, the same officer is still opposing the plea in the high court. He argued that therefore the Central Government is not honest in its approach and is illegally depriving thousands of OBC students across the nation," Wilson said.

It is noted that the MHC cited the pendency of Saloni Kumari matter in the SC regarding the same issue, had asked the petitioners to approach the SC for relief.
