In a petition filed by Justice for Rights Foundation, it has argued that Right to Life and personal liberty and Right to Education under Article 21 and 21A respectively should not be made a part of the trade in the hands of nefarious few.

New Delhi: Justice for Rights Foundation has filed a PIL in the Supreme Court seeking directions to the government to waive off the fees of the University going students and ensure that their names are not deleted or excluded due to the non-payment of semester fee during the lockdown.

The petitioner contends that during the lockdown the colleges are closed and therefore are not in a position to demand the fee as charging fee would further worsen the situation.

It argues that Right to Life and personal liberty and Right to Education under Article 21 and 21A respectively should not be made a part of the trade-in the hands of nefarious few. "This Honorable court laid down the law that educational institutions are not business enterprises and therefore cannot be run with the primary object of making a profit," read the PIL.

It further contended that it is the duty of the state to ensure that the law sustains and proper implementation of its own law and notification especially in the times of medical emergency like this.
