SC to hear plea against Chidambaram's NBW tomorrow

Hours after the Supreme Court Monday asked the trial court to consider former finance minister P Chidambaram's request for interim bail in the INX Media corruption case, Solicitor General Tushar Mehta sought modification of the order.

Considered his request, the apex court advanced the hearing in the case to Tuesday from Thursday.

In the post-lunch session, Mehta appeared before a bench of justices R Banumathi and A S Bopanna and said the order passed earlier in the day would cause jurisdictional difficulty in its implementation.

Taking note of the submissions, the bench said CBI is at liberty to move the trial court for Chidambaram's police custody till Tuesday.

It said it will hear on Tuesday Chidambaram's plea challenging the non-bailable warrent (NBW) against him and remand orders of the trial court in the INX Media case.

SC asks trial court to consider Chidambaram's plea for interim bail

The Supreme Court asked the trial court to consider P Chidambaram's request for interim bail in the INX Media corruption case after the former finance minister said that he not be sent to Tihar jail under judicial custody and offered to be in house arrest.

The apex court said if Chidambaram's request for interim bail is not considered by the trial court on Monday itself, his CBI custody would be extended by three more days.

Later the senior advocate said that if Chidambaram is sent to Tihar jail under judicial custody, his petition would become infructuous.

Sibal said the trial court would "reject" his request and the top court should give him protection till the pending petition is decided.

The bench said:

  • "He (Chidambaram) has to file regular bail plea. The competent court is seized of the matter. Why should we skip the jurisdiction of the regular court and the High Court?"
  • Chidambaram can make a request in this regard before the trial court

"Give me (Chidambaram) interim bail or put me in house arrest. He is a 74-year-old man and has been in CBI custody for last 12 days," Sibal said.

INX media case: SC to hear Chidambaram's plea against remand today

New Delhi: The CBI custody of former finance minister and senior Congress leader, P Chidambaram ended on Monday following which he was produced before the Supreme Court. 

The apex court will hear Chidambaram's petition, challenging the August 22 order of the trial court remanding him to CBI custody in the INX media case. 

The bench has also asked ED to submit the sealed cover after authentication and has listed the matter of challenging the CBI remand.

Kapil Sibal and AM Singhvi responding to the arguments submitted by SG Tushar Mehta, said that they never wanted the material but just asked to test the material which was produced before the accused. 

Sibal also said that conclusion of the ED note had become the conclusion of the judge.

The CBI had, in 2017, registered a case alleging financial irregularities, to the tune of Rs 305 crore, in the Foreign Investment Promotion Board (FIPB) clearance given to INX Media in 2007 when Chidambaram was Union Finance Minister.

Following the FIR filed by the CBI, the Enforcement Directorate had filed a case of money laundering against him.
