Court can take a call on the CBI probe into Sushant's death: Senior lawyer

In an exclusive interaction with ETV Bharat senior criminal lawyer, Mohan Shyam said that CBI can intervene into the death case of late Bollywood star Sushant Singh Rajput if both Bihar and Maharashtra agrees or court directs the investigative agency to look into the matter.

New Delhi: Amid a major controversy following the demand for a Central Bureau of Investigation (CBI) enquiry into the death of late Bollywood actor Sushant Singh Rajput, senior criminal lawyer Mohan Shyam told ETV Bharat on Tuesday that CBI can intervene if both states agree or court directs the investigative agency to look into the matter.

Advocate Shyam, however, said that the CBI cannot itself jump into the investigation. “Court needs to issue proper directions to the CBI and then only it can intervene,” said advocate Shyam.

On Tuesday, Bihar Chief Minister Nitish Kumar demanded a CBI enquiry after Sushant’s father asked for the same. On Monday, majority members of Bihar Assembly cutting across their party lines also supported the action.

A few days back, former MP from Bihar Pappu Yadav also demanded a CBI enquiry into the Sushant’s death.

“We are living in a nation where the federal system exists. The state government has its own investigation agency like Special Investigation Team (SIT) and others who are equipped enough to work and investigate scientifically. It is without a doubt that they can carry an investigation properly. But people sometimes do not have trust in the system. And they demand a central investigation,” said advocate Shyam.

Referring to the Sushant episode, advocate Shyam said that Bihar government can definitely ask for a CBI enquiry following the fact that “big personalities” might be involved in the Sushant episode.

“Looking into the case where big personalities are allegedly involved, the Bihar government is asking for a CBI investigation and as this case is already in the court, the court can take a call into the matter,” said advocate Shyam.

A PIL has already been filled in Mumbai High Court demanding a CBI investigation into the death of Sushant Singh Rajput. Another case was filed in the Supreme Court too into the matter.

Taking Suo-moto cognizance of the matter, the Enforcement Directorate (ED) has already stepped into the picture and is examining the alleged money laundering episode in the death of Sushant.

Followers of the cine star and people in Bihar have also been demanding for a CBI investigation as they claim that “it was a pre-planned murder.”

Public scrutiny and a high-level probe into Sushant’s death on 14 June has been accompanied by an explosion of accusations of nepotism against Bollywood, its big producers, studio houses and star networks.

In fact, death of the upcoming cine star Sushant Singh Rajput has also put into the spotlight the ugly face of nepotism. The incident has also brought into the limelight the bitter ‘insider-outsider’ debate in the glamour world.
