Contempt petition in SC over no panel to review Jammu & Kashmir internet curbs

The Foundation of Media Professionals has moved a contempt petition in the Supreme Court stating that despite the court's order, the government has not set up a special committee to review internet restrictions in Jammu and Kashmir.

New Delhi: The Foundation for Media Professionals has moved to the Supreme Court seeking issue of contempt proceedings against Ajay Kumar Bhalla, Home Secretary, Ministry of Home Affairs and BVR Subramanian, Chief Secretary of J&K for not constituting special committee, as ordered by the apex court on 11th May to determine the necessity of continuing internet restrictions in the Kashmir.

It prays the court to summon them and explain the reasons for not constituting the committee and issue directions for the compliance.

In response to the plea challenging internet restrictions in J&K, filed by the same organisation, the top court on 11th May had ordered constituting a special committee comprising of Secretary of Home Ministry, who also would be the chairperson and constitute the committee, Secretary of Department of Communications, Ministry of Communications and the Chief Secretary of J&K.

It would review the situation the valley and decide on lifting the internet restrictions gradually as per the situation.

According to the petitioner, 29 days have lapsed since the order but the committee has not been formed willfully and there is no public record about the special committee at all.

The notification constituting it, meetings held, the dates, any orders reviewing the situation or proof of compliance etc. nothing is in the public domain. Two representations were also sent highlighting the directions but no reply has been given yet.

Along with contempt proceedings, the organisation seeks directions to the Union of India and Jammu & Kashmir to publicly notify the constitution of the special committee and pass an interim direction restoring 4G speed in the union territory.
