Jain submits that the case should be decided in accordance with the Hindu law because there was a temple before the construction of mosque and once a temple remains always a temple.

When the Sunnis started interfering with the Shia Waqf Board, the Shia’s presented a suit against the Sunnis.

Sunni’s perform Taraweeh during the month of Ramadhan and the Shia’s dont perform as it is prohibited. For their facility, the Shia’s appointed an Imam and later the Sunni’s claimed that the Imam was a Sunni Imam. 

Zaki was the last Mutwalli who was a Shia but he did not claim adverse possession.

"The Mutwalli was in possession but never claimed any adverse possession," said Mr. Shankar Jain. 

Shia Board is also not claiming any adverse possession. I never opposed the Hindu party.

So far as the possession claimed by the Sunnis, there is no basis of claiming it. Every Mosque is a waqf but every waqf is not necessarily a mosque.

Mishra further submits that the prophet has also made it impermissible to offer Namaz facing a graveyard whereas in the present case the disputed structure is surrounded by graveyards.

He quotes Abdul Hakim, a scholar of Shah Jahan’s time, "A Mosque built by demolishing a temple will not make it a Mosque."

NEW DELHI: The Constitution Bench of the Supreme Court is hearing the Ram Janmabhumi-Babri Masjid title dispute case on a day-to-day basis.

Today is the sixteenth day of hearing in the case.

The Ayodhya case is being heard by the Constitution Bench led by Chief Justice of India Ranjan Gogoi and Justices SA Bobde, DY Chandrachud, Ashok Bhushan and Abdul Nazeer. 

Advocate Mishra submits that the Holy Prophet has said that existence of two Qiblas - one of Hindus and the other of Muslims on the same land is prohibited. 

Further Mosque should always be maintained by Muslims and “Adhaan” (Azaan)  should be called out at least twice a day in the Mosque and it should not be used as a place for gossip.

However, 'chulha’ (stove) was found at the site, submits Mishra.

He further submits that according to Hadees Sahih Muslim, decoration of Mosque with idols and images is prohibited as said by the Prophet. Moreover, even  keeping of a doll in the Mosque is prohibited as angels never enter such buildings.

Presence of images and designs in Mosque would divert the attention of the people while offering Namaz, hence the presence of images in Mosque has been prohibited, however, several idols have been recovered from the site, submits Mishra.
