On day 18, SC issues notice to two for threatening advocate Dhavan, as he continues arguments

The Supreme Court on Tuesday sought responses from two persons for allegedly threatening senior advocate Rajeev Dhavan for taking up the case on behalf of the Sunni Waqf Board and other Muslim parties in the Ram Janmabhoomi-Babri Masjid land dispute case.

"Notice," said the five-judge Constitution bench headed by Chief Justice Ranjan Gogoi at the start of hearing on 18th day in the land dispute case. The bench has put up contempt pleas for hearing after two weeks.
  
Dhavan had filed contempt petition against two persons, N Shanmugam, a retired education officer, and a Rajasthan resident, Sanjay Kalal Bajrangi, for allegedly threatening him for appearing for Muslim parties.

On the 18th day of the day-today hearing, Dhavan continued his submissions on behalf of the Muslim parties. He continued with his argument that the inscription contained within the arch of the disputed land structure has the word 'Allah' written on it.

Dhavan: Lord Ram who is being referred as 'Ram lalla Virajmaan' is meaningless since 'virajmaan' means resident of a place. Suit no.5 is malicious since Ramjanmabhoomi is not a juridical person.

Dhavan: It was said that if we cannot accomodate you here we will accomodate you somewhere else. A lot was said about parikrama- the ritual of moving clockwise round an object of devotion as an indication of reverence.

However, does a 'parikrama' lead to an entitlement. They are a form of virtue and do not lead to entitlement.

Dhavan: On 22nd December there was a planned attack on the mosque. The door of the Masjid was locked and the keys were with the muslims. It was opened only on Friday for 2-3 hours for cleaning and for offering the Friday Namaz which infers that there was fear among Muslims from the Hindus and Sikhs.

The Muslims were praying in the inner courtyard. The documents and all the witnesses who have been examined also state that the muslims prayed in the inner courtyard.

Rajeev Dhavan, Counsel for Muslim Party reads the Places of Worship Act, 1991 which provibits the conversion of a place of worship in aplace of worship of the same faith or of a different faith.

Dr. Dhavan submits "You say that they never prayed there, it is so because you never let them pray."

Justice Bobde asks was there any incident when the muslims were not allowed to pray at the mosque.

Dr. Dhavan says the Waqf inspector had submitted a report where it was alleged that the when certain muslims went to pray at the mosque they were stopped by the Hindus and the Sikhs.

The Government of India wanted the restoration of the mosque but Mr k.K Nair, the District Magistrate did not act accordingly.

New Delhi: The Supreme Court commenced hearing in the Ram Janmabhoomi-Babri Masjid case for the 18th day with the bench starts hearing the submissions on behalf of the Muslim Party.

Senior advocate Rajeev Dhavan appearing for the Muslim party said that before he begins he would like to apologise but he had no intention to malign the integrity of the court but perhaps it is well known that he gets irritated.

Dhavan further said that the law which we follow has been inherited from the Law of Justice, Equity and good conscience. The law which we follow is not vedic law.
