New Delhi: The Supreme Court on Monday allowed private schools of Rajasthan to collect an annual fee for the year 2019-20 from the students but by providing a 15% deduction in lieu of unutilized facilities by the students during the 2020-21 year.
The bench comprising of Justice AM Khanilkar and Justice Dinesh Maheshwari pronounced the verdict over a bunch of petitions filed by Rajasthan schools challenging the state government's order on collecting 70% of the fee by CBSE affiliated and 60% by state board affiliated schools.
Today the court ordered that fee to be paid shall be collected by the schools in six equal instalments before August 5, and the school is at liberty to give any further concession to the students.

Court asked the school management to consider the request of those parents who still find it difficult to give a fee.
It ordered that on non-payment of fee students shall not be barred from online classes, exams and getting their results.
After the pandemic and subsequent lockdown in 2020, the state of Rajasthan had allowed deferment of fee by 3 months, reducing the amount to 70% and order that no student shall be expelled for the non-payment.

This was first challenged in the Rajsthan HC where the court had upheld the state's decision.
Later on, the schools moved to the apex court.
