New Delhi: The Supreme Court bench led by Chief Justice SA Bobde has directed the Centre and issued notice to Attorney General KK Venugopal to explain the validity of Section 115 of Mental Health Act which counters the Section 309 of the Indian Penal Code which pertains to surviving suicide attempts.
The court was hearing a petition filed by Animal Rights Activist Sangeeta Dogra who had highlighted the plight of an elephant in a zoo because a man had jumped in its enclosure to commit suicide. Showing a picture of the bound elephant, Dogra contended that this is happening because someone jumped into its enclosure.
The court said that they will issue a notice in the matter and adjourned the hearing.
