Govt working hard to ensure hassle-free transition of J&K

The Union government is working hard to ensure the hassle-free transition of the status of Jammu and Kashmir. The erstwhile state was converted into a Union Territory on August 5 for better administration management thereby, accelerating developmental work in the region.

New Delhi: The Union government is working overtime to set the stage for newly created Union Territories (UTs) of Jammu & Kashmir and Ladakh, official sources said on Saturday.

According to the sources, Union Home Secretary Ajay Kumar Bhalla, along with other officials of the Home Ministry, is working on the future course of action for highly sensitive J&K division.

Jammu & Kashmir and Ladakh will become two separate Union territories from October 31 with a common high court.

The Centre had on August 5 nullified Article 370 of the Constitution, revoking the special status of Jammu and Kashmir, following which the parliament approved the resolution in this connection and also passed the bill on the bifurcation of the state into two UTs.

A few days later on August 9, President Ram Nath Kovind gave assent to the Jammu and Kashmir Reorganisation Act, 2019, bifurcating the two Union Territories, which will come into existence on October 31.

The creation of these new UTs on October 31, would mean overlapping administrative work with the UT division of the Home Ministry. The UT division in the ministry handles matters related to them.

The matters related to the states are handled by the centre-state division of the ministry and it looks after items mentioned in the concurrent list of the constitution.

The Home Ministry is also busy in dealing with the matter of cadre allocation for the Indian Police Service (IPS) officers to be posted in the newly created UTs.

With the formation of new UTs, IPS officers of the Jammu & Kashmir cadre will have to be reallocated to Arunachal Pradesh Goa Mizoram Union Territory (AGMUT ) cadre and all these are being done for the smooth transition of the status of Jammu and Kashmir.

Intro:New Delhi: Ever since Article 370 has been aborgated from Jammu and Kashmir paving the way for bifurcation into Union Territory (UTs), Union Home Secretary Ajay Kumar Bhalla is learnt to have working on the future course of action for highly sensitive J&K division of the Home Ministry.


Body:Sources in the MHA told ETV Bharat that Bhalla is likely to take a call very soon on whether J&K needs to be treated as a separate division handling Jammu, Kashmir and Ladakh or there will be changes in the administrative setup of the division to meet new demands and requirements.

The creation of J&K and Ladakh as Union Territories on October 31, would mean overlapping administrative work with the UT division of MHA. The UT division handles all matters related to Its across India. For the rest of the state, it is centre-state division of the Home Ministry thatbhandlrs items on concurrent list of the Constitution.

Similarly, the Home Ministry is also facing another key issue regarding cadre allocation for the Indian Police Service (IPS) officers. Since MHA is the cadre controlling authority, and with the formal bifurcation of the state, the J&K cadre of IPS officers will have to be reallocated in to AGMUT (Arunachal Pradesh Goa Mizoram Union Territory) cadre.


Conclusion:One of the most sensitive division, the J&K division used to deal with the constitutional matters including Article 370 and general policy matters in respect of J&K including terrorism. It was also responsible for implementation of PM's package in the region. From a small Kashmir desk, it was elevated to a division of the Home Ministry in 1990.

However, for now the J&K division is coordinating for the creation of new assets, bifurcation of existing assets, setting up new schemes and reviewing old packages in the run up to the state's bifurcation.
