Levelling charges against judges just before promotion has become a trend: SC

While dealing with the petition filed by a Madhya Pradesh district judge seeking quashing of sexual harassment charges levelled against him by a lady judicial officer in 2018, SC said that it has become a trend that whenever a judge is on the brink of elevation or promotion, people resort to defamation against him.

New Delhi: The Supreme Court on Friday issued a notice on the petition filed by a Madhya Pradesh district judge seeking quashing of sexual harassment charges levelled against him by a lady judicial officer in 2018.

A constitutional bench headed by the Chief Justice of India (CJI) SA Bobde, observed that whenever a judge is on the brink of elevation or promotion, people resort to defamation against him.

Expressing his disappointment over the trend, CJI said, "It is unfortunate that when a judge is likely to be promoted in a better position, people level charges against him to defame the person".

Advocate for the MP Judge contended that he has had an unblemished career of 32 years but when he was set to be promoted to Madras High Court judge, charges were levelled against him, an inquiry was initiated and he had to face sheer embarrassment.

Admitting the advocate's pointers, the court stayed the disciplinary proceedings against the judge.
