Google says Delhi HC order in Subodh Gupta case can have 'Chilling Effect on Free Speech'

Google moved an application before the Delhi High Court seeking vacation of the order to take down anonymous posts containing #MeToo allegations against artist Subodh Gupta. A defamation case was filed by Gupta against Instagram account @herdsceneand and others for publishing allegedly false content against him.

New Delhi:After the Delhi High Court ordered Google, Facebook and Instagram to take down anonymous posts containing #MeToo allegations against artist Subodh Gupta, Google has moved an application before the Delhi High Court seeking vacation of the order.

The application stated that the order should be set aside or else it will have a "chilling effect" on public rights and interests.

A defamation case was filed by Gupta against Instagram account @herdsceneand and others for publishing allegedly false content against him. He is also seeking Rs 5 crore for damage caused to himself and his family due to the posts.

Posts on Instagram by 'Scene and Herd', a handle that has been aggressively exposing inappropriate behaviour in the Indian art world, was anonymous, Rosalyn D'mello, who has been actively writing on art for the past decade, said she backed the allegations.

"I deny the anonymous allegations made on the Instagram account @herdsceneand in their entirety; I have never behaved in an inappropriate manner with any individual who worked with me and several of my former assistants can attest to this. These allegations are entirely false and fabricated," Gupta had said in an interview before.
