C'garh woman's kidney removed without consent

Sumitra Bai was diagnosed with kidney stone and was admitted at Vananchal Care Hospital in Chhattisgarh's Raigarh district. On May 30, she underwent a surgery to get her kidney stones removed, but post- operation Bai's family came to know that her kidney was removed with doctors citing "severe infection" in the organ.

Raigarh (Chhattisgarh):In an alleged case of medical negligence, two doctors from a private hospital and one from a district hospital in Kharsiya of Chhattisgarh's Raigarh district on Monday have been accused of removing a kidney of one Sumitra Bai, without consulting the family or the patient, while she was undergoing treatment for nephrolithiasis, also known as kidney stone.

62-year-old Sumitra Bai was diagnosed with stones in her left kidney and was admitted at Vananchal Care Hospital, a private hospital in Kharsiya town of Raigarh district on May 26.

Bai underwent surgery on May 30 for removal of her kidney stones which was performed by Dr. V S Rathiya and Dr. R K Singh from the private hospital and Dr. Sajan Agrawal, from the Raigarh civil hospital.

But, Bai's son, Aishwarya Prasad Patel has filed a First Information Report (FIR) at the Kharsiya police station on June 3 against the three doctors accusing them of removing her mother's kidney without seeking the consent of either the family or the patient, following "a severe infection" in the organ. Patel has further accused the doctors of "not showing the kidney" that was removed by them, despite several demands laid by the family.

However, the doctors accused of the crime continue to maintain that they were forced to remove the kidney as it was "infected beyond repair".

"The matter is being investigated. The doctors are arguing that they had to undertake the procedure because of an infection, but if proven guilty they will be subjected to suspension. Meanwhile, the patient is in a conscious state now and is doing well, " said Dr. Suresh Rathiya, a doctor practising at a civil hospital in Raigarh.

An investigation into the allegation is underway and the police are examining both the pre-surgery and post-surgery reports of Bai, to ascertain if it was necessary to remove the kidney.

"We are conducting an inquiry to see if the attendants of the patient were consulted or not before undertaking the procedure. We are also investigating the statements made by the doctors where they are saying that the infection had spread to her kidney which made it imperative to remove it. We are investigating various angles to this story, " said Garima Dwivedi, Sub-Divisional Police Officer, Kharsiya.
